In January 2014, the government of Brazil initiated a new anti-dumping investigation and a definitive duty was imposed in March 2015. In March 2020, a sunset review was initiated on imports from China, Chinese Taipei, the European Union and the United States of America whilst the definitive duty was terminated on imports from Hong Kong.

Anti-dumping

On February 24, 2014, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of pre-sensitized aluminium plates, analogic or digital, for off-set printing (used for the printing of newspapers, books, magazines, printing for newspaper companies in general, packaging, publishing and graphics in general) from China, Chinese Taipei, the European Union, Hong Kong and the United States of America (Circular No. 10, 24.02.2014).
The products subject to investigation are classified under the following HS codes: 3701.3021 and 3701.3031.
The complaint was lodged on January 31, 2014 by IBF Indústria Brasileira de Filmes S/A. The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on February 25, 2014.
 
On July 24, 2014, the Brazilian Ministry of Development, Industry and Foreign Trade made a preliminary determination of dumping against imports of photographic plates originating in China, Chinese Taipei, the European Union, Hong Kong and the United States of America (Circular No. 43, 24.07.2014). No provisional duty was imposed yet. The investigation continues until the final determination. Circular No. 43 was published in the Federal Official Gazette of Brazil on July 25, 2014.
 
On December 15, 2014, the Brazilian authorities decided to extend for up to eight months, from December 25, 2014, the investigation period to determine the existence of dumping (Circular No. 79, 15.12.2014). Circular No. 79 was published in the Federal Official Gazette of Brazil on December 16, 2014.
 
On March 4, 2015, the Brazilian authorities decided to impose a definitive anti-dumping duty on imports of the above-mentioned products originating in China, Chinese Taipei, the European Union, Hong Kong and the United States of America (Resolution No. 9, 04.03.2015).
The amount of the duty imposed on imports originating in China ranges from USD 2.09 to USD 2.35 per kilogram, depending on the company. The amount of the duty imposed on imports originating in Hong Kong is USD 5.86 per kilogram. The amount of the duty imposed on imports originating in Chinese Taipei is USD 10.97 per kilogram, at the exception of the companies Top High Image Corporate, Graphic International Printing Material Co. Ltd. and Angel Star (T.P.) Co. Ltd. whose exports are subject to a duty of USD 0.19 per kilogram. The amount of the duty imposed on imports originating in the United States of America is USD 1.58 per kilogram. The amount of the duty imposed on imports originating in the European Union is USD 4.80 per kilogram. This definitive duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on March 5, 2015, and is applicable for a period of five years.

On 5 March 2020, the Brazilian authorities initiated a sunset review of the definitive duty imposed on imports of the subject good from China, Chinese Taipei, the European Union including the United Kingdom and the United States. The sunset review does not cover imports from Hong Kong and therefore the duty was terminated from 5 March 2020. The review follows the application lodged by IBF Indústria Brasileira de Filmes S.A. and Agfa Gevaert do Brasil Ltda.
