Anti-subsidy

On February 6, 2014 the Commissioner of the Australian Anti-Dumping Commission initiated an anti-subsidy investigation on imports of silicon metal containing at least 96.00 percent but less than 99.99 percent silicon by weight and silicon metal containing between 89.00 percent and 96.00 percent silicon by weight that contains aluminium greater than 0.20 percent by weight, of all forms (i.e. lumps, granules or powder) and sizes, from China (Anti-Dumping Notice No. 2014/08, 06.02.2014).
The products subject to investigation are classified under the following HS code: 2804.6900.
The complaint was lodged on January 10, 2014 by Simcoa Operations Pty Ltd.
An anti-dumping investigation concerning imports of the same goods originating in China was also initiated (see measure 5983).
 
On May 28, 2014, the Australian Anti-Dumping Commission extended the time granted to issue the Statement of Essential Facts (Anti-Dumping Notice No. 2014/45, 28.05.2014).
 
On August 25, 2014, the Australian Anti-Dumping Commission extended again the time granted to issue the Statement of Essential Facts (Anti-Dumping Notice No. 2014/76, 25.08.2014).
 
On October 24, 2014, the Australian Anti-Dumping Commission further extended the time granted to issue the Statement of Essential Facts (Anti-Dumping Notice No. 2014/108, 24.10.2014).
 
On February 23, 2015, the Australian Customs and Border Protection Service issued the Statement of Essential Facts (SEF Report No. 237).
 
On the same day, the Australian Anti-Dumping Commission decided to impose a provisional countervailing duty on imports of the above-mentioned products originating in China (Anti-Dumping Notice No. 2015/22).
The rate of the duty is 53.8%, at the exception of the goods produced by the companies Hua'an Linan Silicon Industry Co., Ltd. and Guizhou Liping Linan Silicon Industry Co., Ltd. and supplied through the company Xiamen K Metal Co., Ltd., which are subject to a duty of 14.1%.
It should be noted that this measure is a combination of an anti-subsidy measure and an anti-dumping measure (see measure 5983), i.e. that the rate of the duty accounts for both the countervailing duty and the anti-dumping duty.
 
On April 7, 2015, the Australian Anti-Dumping Commission extended the time granted to issue the Final Report (Anti-Dumping Notice No. 2015/46, 07.04.2015).
 
On June 3rd, 2015, the Australian Anti-Dumping Commission decided to impose a definitive countervailing duty on imports of the above-mentioned products originating in China (Anti-Dumping Notice No. 2015/71).
The rate of the duty is 58.3%, at the exception of the goods produced by the companies Hua'an Linan Silicon Industry Co., Ltd. and Guizhou Liping Linan Silicon Industry Co., Ltd. and supplied through the company Xiamen K Metal Co., Ltd., which are subject to a duty of 12.0%.
It should be noted that this measure is a combination of an anti-subsidy measure and an anti-dumping measure (see measure 5983), i.e. that the rate of the duty accounts for both the countervailing duty and the anti-dumping duty.
