Anti-dumping

On July 17, 2008, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of small graphite electrodes with diameter up to 450 mm (18 inches), of any length, machined or not machined, assembled or unassembled, of a kind used for electric furnaces from China (Circular No. 49, 17.07.2008).
The products subject to investigation are classified under the following HS codes: 8545.1100 and 3801.1000.
The complaint was lodged by Graftech Brasil Ltda. on April 17, 2008. The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on July 18, 2008.
 
On April 8, 2009, the Brazilian authorities decided to impose a definitive anti-dumping duty on imports of graphite electrodes from China (Resolução No. 19, 08.04.2009).
The amount of this definitive duty in USD per tonne is 2,259.46 for all Chinese exporters. This definitive anti-dumping duty entered into force on April 9, 2009 for a period of five years.
 
On April 4, 2014, the Secretary for Foreign Trade of the BrazilianMinistry of Development, Industry and Foreign Trade decided to initiatean expiry review of the anti-dumping duty imposed byResolution No. 19 dated April 8, 2009 (Circular No. 14, 04.04.2014). Thereview was requested on December 9, 2013 by Graftech. The reviewstarted on the day of the publication of the circular in the FederalOfficial Gazette of Brazil, i.e. on April 7, 2014.
 
On January 28, 2015, the Brazilian authorities decided upon the continuation of the definitive anti-dumping duty imposed on imports of graphite electrodes originating in China (Resolution No. 5, 28.01.2015). The amount of the duty remains USD 2,259.46 per metric ton.
This definitive duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on January 30, 2015, and is applicable for a period of five years.
 
On September 8th, 2015, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-circumvention investigation on imports of graphite electrodes from the United Arab Emirates and the United Kingdom (Circular No. 57, 08.09.2015). Anti-circumvention

On September 8th, 2015, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-circumvention investigation on imports of graphite electrodes from the United Arab Emirates and the United Kingdom (Circular No. 57, 08.09.2015).
This investigation follows suspicion that the definitive anti-dumping duty imposed by Resolution No. 5 dated January 28th, 2015 on imports of graphite electrodes from China might be circumvented (see related intervention).
The products subject to investigation are classified under the following HS codes: 3801.1000 and 8545.1100.
The complaint was lodged on July 1st, 2015 by Graftech Brasil Participações Ltda. The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on September 9th, 2015.

On 15 February 2016, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade terminated the anti-circumvention investigation (Circular No. 9, 12.02.2016).
