In February 2012, the government of Brazil initiated a sunset review and extended the definitive duty in February 2013. In February 2018, a sunset review was initiated and the definitive duty was terminated in February 2019.

Anti-dumping

On February 5, 2013, the Brazilian authorities decided, after having conducted an expiry review, to continue the anti-dumping duty on imports of powdered milk, whole or skimmed, from the European Union and New Zealand (Resolução No. 2, 05.02.2013).The products subject to the duty are classified under the following HS codes: 0402.1010, 0402.1090, 0402.2110, 0402.2120, 0402.2910 and 0402.2920. The rate of this definitive duty is 14.8% for imports from the European Union and 3.9% for imports from New Zealand. This definitive anti-dumping duty entered into force on February 6, 2013 for a period of five years. This duty follows an expiry review requested by the Agriculture National Confederation (Confederação Nacional da Agricultura - CNA) on November 11, 2011. A review was then initiated by the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade on February 13, 2012 (Circular No. 2, 13.02.2012). The review started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on February 14, 2012. The original anti-dumping duty entered into force on February 23, 2001 (Resolução No. 1, 02.02.2001). This duty was then extended on February 15, 2007 (Resolução No. 4, 09.02.2007).

On 6 February 2018, the Brazilian authorities initiated a sunset review of the antidumping duty imposed on imports of the subject product imported from the European Union and New Zealand (Circular No. 7 of 2018). This follows the application lodged on 6 October 2017 by the Confederation of Agriculture and Livestock of Brazil (Confederação da Agricultura e Pecuária do Brasil).

On 6 February 2019, the Brazilian authorities terminated the definitive duty following the conclusion of the subset review.
