Anti-dumping

On July 12, 2013, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of clear (colourless) flat glass, produced according to the floatation method (floatglass), with a thickness of 2 to 19 mm, from China, Egypt, Mexico, Saudi Arabia, the United Arab Emirates and the United States of America (Circular No. 38, 12.07.2013). The product subject to investigation is classified under the following HS code: 7005.2900. The complaint was lodged by the Brazilian sectorial organisation Associação Técnica Brasileira das Indústrias Automáticas de Vidro (ABIVIDRO) on January 31, 2013. The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on July 15, 2013.
On June 24, 2014, the Brazilian authorities decided to extend for up to six months, from July 15, 2014, the investigation period to determine the existence of dumping in exports of the goods under scrutiny from China, Egypt, Mexico, Saudi Arabia, the United Arab Emirates and the United States of America (Circular No. 39, 24.06.2014). Circular No. 39 was published in the Federal Official Gazette of Brazil on June 26, 2014.
On July 11, 2014, the Brazilian authorities decided to impose a provisional anti-dumping duty on imports of flat glass from China, Egypt, Mexico, Saudi Arabia, the United Arab Emirates and the United States of America (Resolution No. 55, 11.07.2014). The amount of the duty imposed on imports originating in Saudi Arabia is USD 172.27 per metric ton. The amount of the duty imposed on imports originating in China ranges from USD 219.07 to USD 334.35 per metric ton. The amount of the duty imposed on imports originating in Egypt is USD 125.10 per metric ton. The amount of the duty imposed on imports originating in the United Arab Emirates is USD 126.54 per metric ton, at the exception of the company Emirates Float Glass LLC whose exports are subject to a duty of USD 65.87 per metric ton. The amount of the duty imposed on imports originating in the United States of America is USD 301.50 per metric ton, at the exception of the companies Cardinal FG and AGC Flat Glass North America, Inc. whose exports are subject to a duty of USD 92.90 per metric ton. The amount of the duty imposed on imports originating in Mexico is USD 52.31 per metric ton, at the exception of the company Guardian Industries V.P.S. de RL de CV whose exports are subject to a duty of USD 17.40 per metric ton.
This provisional duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on July 14, 2014, and is applicable for a period of six months.
On December 18, 2014, the Brazilian authorities decided to impose a definitive anti-dumping duty on imports of flat glass from China, Egypt, Mexico, Saudi Arabia, the United Arab Emirates and the United States of America (Resolution No. 121, 18.12.2014). The amount of the duty imposed on imports originating in Saudi Arabia is USD 202.26 per metric ton. The amount of the duty imposed on imports originating in China ranges from USD 179.46 to USD 392.55 per metric ton, depending on the company. The amount of the duty imposed on imports originating in Egypt is USD 185.74 per metric ton. The amount of the duty imposed on imports originating in the United Arab Emirates is USD 148.57 per metric ton, at the exception of the company Emirates Float Glass LLC whose exports are subject to a duty of USD 83.40 per metric ton. The amount of the duty imposed on imports originating in the United States of America is USD 366.78 per metric ton, at the exception of the companies Cardinal FG and AGC Flat Glass North America, Inc. whose exports are subject to a duty of USD 97.01 per metric ton and USD 177.81 per metric ton respectively. The amount of the duty imposed on imports originating in Mexico ranges from USD 139.60 to USD 359.30 per metric ton, at the exception of the company Guardian Industries V.P.S. de RL de CV whose exports are not subject to the payment of a duty. This definitive duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on December 19, 2014, and is applicable for a period of five years.
