Anti-dumping

On March 18, 2013, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of polypropylene resin (existing in two different forms: 1/ polymers of propylene or of other olefins, in primary forms; polypropylene unloaded (HOMO); 2/ polymers of propylene or of other olefins, in primary forms; propylene copolymers (COPO)) from India, Korea and South Africa (Circular No. 14, 18.03.2013).
The products subject to investigation are classified under the following HS codes: 3902.1020 and 3902.3000.
The investigation started on the day of the publication ofthe circular in the Federal Official Gazette of Brazil, i.e. on March19, 2013. The complaint was lodged by Braskem S.A. and Braskem Petroquímica S.A. on July 31, 2012.
On January 16, 2014, the Brazilian Ministry of Development, Industry and Foreign Trade decided to impose a provisional anti-dumping duty on imports of polypropylene resin from India, Korea and South Africa (Resolução No. 02, 16.01.2014). The amount of the duty in USD per tonne ranges from 100.22 to 109.89 for Indian exporters (depending on the company), from 26.11 to 101.39 for Korean exporters (depending on the company) and from 111.78 to 161.96 for South African exporters (depending on the company). This provisional duty has entered into force on January 17, 2014 for a period of six months.
On February 21, 2014, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to extend for up to six months, from March 19, 2014, the investigation period to determine the existence of dumping in exports of polypropylene resin from India, Korea and South Africa to Brazil (Circular No. 8, 21.02.2014).
On August 27, 2014, the Brazilian Ministry of Development, Industry and Foreign Trade decided to impose a definitive anti-dumping duty on imports of polypropylene resin originating in India, South Korea and South Africa (Resolution No. 75, 27.08.2014). The rate of the duty imposed on imports originating in South Africa is 16%. The rate of the duty imposed on imports originating in South Korea ranges from 2.4% to 6.3%, depending on the producer/exporter. The rate of the duty imposed on imports originating in India is 9.9%, at the exception of the company Reliance Industries Limited whose exports are subject to a duty of 6.4%. This definitive anti-dumping duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on August 28, 2014, and is applicable for a period of five years.
