In October 2013, the government of Brazil initiated a new anti-dumping investigation and a definitive duty was imposed in August 2014. In August 2019, a sunset review was initiated and the duty was extended for a new period in June 2020.

Anti-dumping

On November 14, 2013, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of sodium acid pyrophosphate (SAPP) from Canada, China and the United States of America (Circular No. 72, 14.11.2013). The product subject to investigation is classified under the following HS code: 2835.3920. The complaint was lodged by ICL Brasil Ltda. on October 31, 2013. The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on November 18, 2013.

On March 17, 2014, the Brazilian authorities decided to impose a provisional anti-dumping duty on imports of sodium acid pyrophosphate from Canada, China and the United States of America (Resolution No. 22, 17.03.2014). The amount of the duty imposed on imports originating in Canada is USD 2,053.11 per ton. The amount of the duty imposed on imports originating in China ranges from USD 769.37 to USD 2,225.34 per ton, depending on the exporting company. The amount of the duty originating in the United States of America is USD 1,932.57 per ton. This provisional duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on March 19, 2014, and is applicable for a period of six months.

On August 14, 2014, the Brazilian Ministry of Development, Industry and Foreign Trade decided to impose a definitive anti-dumping duty on imports of sodium acid pyrophosphate originating in Canada, China and the United States of America (Resolution No. 67, 14.08.2014). The amount of the duty imposed on imports originating in Canada is USD 2,281.23 per metric ton, at the exception of the company Innophos Canada Inc. whose exports are subject to a duty of USD 546.30 per metric ton. The amount of the duty imposed on imports originating in China ranges from USD 684.27 to USD 2.534.07per metric ton, depending on the producer/exporter. The amount of the duty imposed on imports originating in the United States of America is USD 2,147.30 per metric ton, at the exception of the company Innophos Inc. whose exports are subject to a duty of USD 418.13 per metric ton. This definitive anti-dumping duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on August 15, 2014, and is applicable for a period of five years.

On 15 August 2019, the Brazilian authorities initiated a sunset review of the antidumping duty imposed on imports of the subject good from Canada, China and the United States. This follows the application lodged on 15 April 2019 by ICL Brasil Ltda.

On 15 June 2020, the Brazilian authorities extended the definitive duty for a new period following the conclusion of the sunset review. The rate of duty on imports from Canada is USD 546.30 or 1,066.30 per tonne. The rate of duty on imports from China is between USD 850.97 and 1,248.71 per tonne. The rate of duty on imports from the United States is USD 418.13 or 2,147.30 per tonne. The duty is in force for a period of five years.
