Anti-dumping

On December 24, 2007, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of butyl acrylate from the United States of America (Circular No. 71, 21.12.2007).
The product subject to investigation is classified under the following HS code: 2916.1230.
The complaint was lodged on September 14, 2007 by Basf S.A.
The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on December 24, 2007.
 
On July 3, 2008, the Brazilian authorities decided to impose a provisional anti-dumping duty on imports of butyl acrylate originating in the United States of America (Resolution No. 41, 03.07.2008). The amount of the duty is USD 0.12 per kilogram, at the exception of the company Arkema Inc. whose exports are subject to a duty of USD 0.06 per kilogram. This provisional duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on July 4, 2008, and is applicable for a period of six months.
 
On March 24, 2009, the Brazilian authorities decided to impose a definitive anti-dumping duty on imports of butyl acrylate originating in the United States of America (Resolution No. 15, 24.03.2009). The amount of the duty ranges from USD 0.08 to USD 0.42 per kilogram, depending on the producer. This definitive duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on March 25, 2009, and is applicable for a period of five years.
 
On January 24, 2014, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate a sunset review of the anti-dumping duty imposed by Resolution No. 15 dated 24.03.2009 on imports of butyl acrylate originating in the United States of America (Circular No. 1, 24.01.2014). The application for the review was lodged on November 22, 2013 by Basf S.A. The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on January 27, 2014.
 
On December 18, 2014, the Brazilian authorities decided upon the continuation of the definitive anti-dumping duty imposed on imports of butyl acrylate originating in the United States of America (Resolution No. 120, 18.12.2014). The amount of the duty is USD 0.42 per kilogram, at the exception of the companies Arkema Inc., The Dow Chemical Company and Rohm and Haas Company e Rohm and Haas Texas Inc. whose exports are subject to a duty of USD 0.19 per kilogram. This extension entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on December 19, 2014, and is applicable for a period of five years.
