Anti-dumping

On December 13, 2013, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of adipic acid from China, France, Germany, Italy and the United States of America (Circular No 75, 13.12.2013).
The product subject to investigation is classified under the following HS code: 2917.1210.
The complaint was lodged by Rhodia Poliamida e Especialidades Ltda.
 
On April 14, 2014, the Brazilian Ministry of Development, Industry and Foreign Trade made a preliminary determination of dumping against imports of adipic acid from China, France, Germany, Italy and the United States of America (Circular No. 18, 14.04.2014). The investigation continues until the final determination. Circular No. 18 was published in the Federal Official Gazette of Brazil on April 15, 2014.
 
On September 24, 2014, the Brazilian authorities decided to extend for up to six months, from October 16, 2014, the investigation period to determine the existence of dumping in exports of adipic acid from China, France, Germany, Italy and the United States of America (Circular No. 57, 24.09.2014). Circular No. 57 was published in the Federal Official Gazette of Brazil on September 25, 2014.
 
On March 31, 2015, the Brazilian authorities decided to impose a definitive anti-dumping duty on imports of adipic acid originating in China, France, Germany, Italy and the United States of America (Resolution No. 15, 31.03.2015).
The amount of the duty imposed on imports originating in Germany is USD 375.88 per metric ton. The amount of the duty imposed on imports originating in the United States of America is USD 405.92 per metric ton. The amount of the duty imposed on imports originating in France is USD 184.63 per metric ton. The amount of the duty imposed on imports originating in Italy is USD 287.24 per metric ton. The amount of the duty imposed on imports originating in China is USD 321.05 per metric ton.
This definitive duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on April 1, 2015, and is applicable for a period of five years.
