Anti-dumping

On October 28, 2008, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of ballpoint pens made of plastic resins from China (Circular No. 71, 28.10.2008).
The products subject to investigation are classified under the following HS code: 9608.1000.
The complaint was lodged on July 11, 2008 by Bic Amazônia S.A.
The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on October 30, 2008.

On April 28, 2010, the Brazilian authorities decided to impose a definitive anti-dumping duty on imports of ballpoint pens from China (Resolution No. 24, 28.04.2010). The amount of the duty is USD 14.52 per kilogram. This definitive duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on April 29, 2010, and is applicable for a period of five years.

On April 27th, 2015, the Brazilian authorities decided to initiate a sunset review of the anti-dumping measure imposed by Resolution No. 24 dated April 28th, 2010 on imports of ballpoint pens originating in China (Circular No. 29, 27.04.2015).
It follows a request lodged on December 22nd, 2014 by Bic Amazônia S.A. This sunset review started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on April 28th, 2015. The existing anti-dumping measure remains in force during the review.
 
On 19 February 2016, the Brazilian authorities extended the imposition of definitive anti-dumping duty on imports of ballpoint pens originating in China for a five-year period (Resolution No. 11 of 18 February 2016). The amount of duty imposed is USD 14.52 per kg.
