In April 2010, the government of Brazil imposed a definitive duty on imports of ballpoint pens from China. In April 2015, a sunset review was initiated and the definitive duty was extended for a new period in February 2016. In February 2021, a sunset review was initiated.

Anti-dumping

On April 28, 2010, the Brazilian authorities decided to impose a definitive anti-dumping duty on imports of ballpoint pens from China (Resolution No. 24, 28.04.2010). The products subject to duties are classified under the following HS code: 9608.1000. The amount of the duty is USD 14.52 per kilogram. This definitive duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on April 29, 2010, and is applicable for a period of five years. This follows the conclusion of an investigation initiated on 28 October 2008. 

On April 27th, 2015, the Brazilian authorities decided to initiate a sunset review of the anti-dumping measure imposed by Resolution No. 24 dated April 28th, 2010 on imports of ballpoint pens originating in China (Circular No. 29, 27.04.2015).
It follows a request lodged on December 22nd, 2014 by Bic Amazônia S.A. This sunset review started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on April 28th, 2015. The existing anti-dumping measure remains in force during the review.
 
On 19 February 2016, the Brazilian authorities extended the imposition of definitive anti-dumping duty on imports of ballpoint pens originating in China for a five-year period (Resolution No. 11 of 18 February 2016). The amount of duty imposed is USD 14.52 per kg.

On 19 February 2021, the Brazilian authorities initiated a sunset review of the definitive duty imposed on imports of the subject good from China. This follows the application lodged on 16 October 2020 by Bic Amazônia S.A. The duty will remain in force for the duration of the review.
