ANNOUNCEMENT 25 Nov 2008

In November 2008, the government of India initiated a new anti-dumping investigation and imposed definitive duties in April 2009. In February 2010, a definitive duty was imposed on imports from China, Chinese Taipei, the EU, South Africa, the Republic of Korea, Thailand and the United States. No duty was extended on imports from Japan. In In April 2014, a sunset review was initiated and the definitive duty was extended for a new period in December 2015. In September 2020, a sunset review was initiated.

Anti-dumping

On November 25, 2008, the Indian authorities initiated an anti-dumping investigation on imports of cold-rolled flat products of stainless steel originating in China, Chinese Taipei, the European Union, Japan, South Africa, South Korea, Thailand and the United States of America. The products subject to investigation are classified under the following HS codes: 7219.3100, 7219.3200, 7219.3300, 7219.3400, 7219.3500 and 7219.9000.

On March 27, 2009, the Indian authorities issued their preliminary findings and recommended the imposition of a provisional anti-dumping duty. This provisional duty was imposed on April 22, 2009 (Notification No. 38/2009-Customs, 22.04.2009). For details about the amount of the duty, see the table in Notification No. 38/2009. This provisional duty is effective upto and inclusive of October 21, 2009.

On November 24, 2009, the Indian authorities issued their final findings and recommended the imposition of a definitive anti-dumping duty for all countries except Japan. This definitive duty was imposed on February 20, 2010 (Notification No. 14/2010-Customs, 20.02.2010). For details about the amount of the duty, see the table in Notification No. 14/2010. This definitive duty is effective for a period of five years with effect from the date of imposition of the provisional anti-dumping duty, i.e. from April 22, 2009.
No duty definitive anti-dumping duty was imposed on imports originating in Japan since those exports were considered as de minimis. Therefore the investigation was terminated as far as Japan is concerned.

On April 17, 2014, the Indian authorities initiated a sunset review of the anti-dumping duty imposed on imports of cold-rolled flat products of stainless steel originating in China, Chinese Taipei, the European Union, South Africa, South Korea, Thailand and the United States of America.

On May 12, 2014, the Indian authorities issued the notification of provisional extension of the existing anti-dumping duty up to and inclusive of April 21, 2015.

On October 12th, 2015, the Indian Directorate General of Anti-dumping & Allied Duties, Ministry of Commerce & Industry, issued its final findings of the sunset review. It recommended the continuation of the existing anti-dumping measure imposed on imports of cold-rolled flat products of stainless steel originating in China, Chinese Taipei, the European Union, South Africa, South Korea, Thailand and the United States of America.

On 11 December 2015, the Indian authorities published the above-mentioned Customs Notification imposing the anti-dumping duty on cold-rolled flat products of stainless steel from the above-specified countries. The product is classified under HS code 7219 The duty is applied to the country of origin or exports of the aforementioned countries. The duty is a percentage of the landed value of that product. The rate of duty imposed on imports from China is 57.39%. The rate of duty imposed on imports from South Korea is 13.44%. This is with the exception of one producer and two exporters, which are subject to a 5.39% duty. The rate of duty imposed on imports from Chinese Taipei is 15.93%. The rate of the duty imposed on imports from South Africa is 39.91% with the exception of one producer/exporter levied at 12.34%. The rate of the duty imposed on imports from Thailand is 5.39% with the exception of one producer/exporter levied at 4.58%. The rate of duty imposed on imports from the United States is 9.47%. The rate of the duty imposed on imports from the European Union is 52.56% with the exception of one producer/exporter levied at 29.41%.

On 30 September 2020, the Indian authorities initiated a sunset review of the definitive duty imposed on certain cold-rolled flat products of stainless steel originating in China, Chinese Taipei, the European Union, Japan, South Africa, South Korea, Thailand and the United States of America. The review follows the application lodged by Jindal Stainless Limited, Jindal Stainless (Hisar) Limited and Jindal Stainless Steelway Ltd

Anti-dumping

On November 25, 2008, the Indian authorities initiated an anti-dumping investigation on imports of certain cold-rolled flat products of stainless steel from Japan as well as China, Chinese Taipei, the European Union, Japan, South Africa, South Korea, Thailand and the United States of America. The products subject to investigation are classified under the following HS codes: 7219.3100, 7219.3200, 7219.3300, 7219.3400, 7219.3500 and 7219.9000.

On 22 April 2009, the Indian authorities imposed of a provisional anti-dumping duty on imports of the subject good from Japan as well as China, Chinese Taipei, the European Union, Japan, South Africa, South Korea, Thailand and the United States of America (see related intervention). The rate of duty on imports from Japan is USD 780 per tonne. The duty is in force until 21 October 2009.

On 24 November 2009, the Indian authorities issued their final findings and recommended the imposition of a definitive anti-dumping duty for all countries except Japan. This definitive duty was imposed on 20 February 2010 (Notification No. 14/2010-Customs, 20.02.2010), see related intervention.
