Anti-dumping

On November 1, 2013, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of plastic blood collection tubes from China, Germany, the United Kingdom and the United States of America (Circular No. 64, 01.11.2013).
The products subject to investigation are classified under the following HS codes: 3822.0090, 3926.9040 and 9018.3999.
The complaint was lodged on April 30, 2013 by Greiner Bio-One Brasil Produtos Médicos Hospitalares Ltda. The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on November 4, 2013.
 
On October 31, 2014, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to extend for up to six months, from November 4, 2014, the investigation period to determine the existence of dumping in exports of plastic blood collection tubes from China, Germany, the United Kingdom and the United States of America (Circular No. 67, 31.10.2014). Circular SECEX No. 67 was published in the Federal Official Gazette of Brazil on November 3, 2014.
 
On April 29th, 2015, the Brazilian authorities decided to impose a definitive anti-dumping duty on imports of plastic blood collection tubes from China, Germany, the United Kingdom and the United States of America (Resolução No. 26, 29.04.2015).
The rate of the duty imposed on imports originating in Germany is 93.3%, at the exception of the company Sarstedt AG & Co. whose exports are subject to a duty of 11.1%. The rate of the duty imposed on imports originating in China is 638.1%, at the exception of the companies Guangzhou Improve Medical Instruments Co. Ltd. (49.5%), Weihai Hongyu Medical Devices Co. Ltd. (97.8%) and Zhejiang Gongdong Medical Plastic Factory (80.7%). The rate of the duty imposed on imports originating in the United States of America is 86.5%, at the exception of the company Becton Dickinson and Company whose exports are subject to a duty of 45.3%. The rate of the duty imposed on imports originating in the United Kingdom is 492.8%, at the exception of the company Becton Dickinson and Company whose exports are subject to a duty of 71.5%.
This definitive anti-dumping duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on April 30th, 2015, and is applicable for a period of five years.
