Anti-dumping

On June 6, 2008, the Indian authorities initiated an anti-dumping investigation on imports of plain medium density fibre board from China, Malaysia, New Zealand, Thailand and Sri Lanka.
The products subject to investigation are classified under the following HS code: 4411.0000.
 
On February 2, 2009, the Indian authorities in their preliminary findings found evidence of positive dumping margin. Thus, a provisional anti-dumping duty was imposed on February 27, 2009 (Notification No. 21/2009 - Customs, 27.02.2009).
 
On August 26, 2009, the Indian authorities issued their final findings and recommended the imposition of a definitive anti-dumping duty. This definitive duty was imposed on October 8, 2009 (Notification No.116/2009-Customs, 08.10.2009). This definitive anti-dumping duty took effect from the date of imposition of the provisional anti-dumping duty, that is, February 27, 2009.
Imports from New Zealand are not subject to the payment of any since since the domestic industry have withdrawn their application in respect of New Zealand in view of the fact that imports from that country were primarily present in a market segment where the domestic industry was not offering the material in significant volumes.
 
On February 18, 2014, the Indian authorities initiated a sunset review of the anti-dumping duty imposed on imports of plain medium density fibre board from China, Malaysia, Thailand and Sri Lanka.
 
On March 12, 2014, the Indian Ministry of Finance decided to provisionaly extend during the sunset review the anti-dumping duty imposed on October 8, 2009 by Notification No. 116/2009-Customs up to February 26, 2015 (Notification No. 12/2014-Customs (ADD), 12.03.2014).
 
On February 23rd, 2015, the Indian authorities extended the time for completing the sunset review up to August 17th, 2015.
 
On August 17th, 2015, the Indian Directorate General of Anti-dumping & Allied Duties, Ministry of Commerce & Industry, issued its final findings of the sunset review. It recommended the continuation of the existing anti-dumping measure.
 
On October 21st, 2015, the Indian Ministry of Finance issued the Customs Notification of extension of the anti-dumping duty imposed on imports of plain medium density fibre board from China, Malaysia, Thailand and Sri Lanka (Notification No. 48/2015-Customs (ADD), 21.10.2015).
The amount of the duty imposed on imports originating in China is USD 46.09 per cubic metre. The amount of the duty imposed on imports originating in Thailand is USD 45.27 per cubic metre. The amount of the duty imposed on imports originating in Malaysia is USD 36.10 per cubic metre, at the exception of the company M/s Robin Resources (Malaysia) Sdn Bhd whose exports are subject to a duty of USD 5.72 per cubic metre. The amount of the duty imposed on imports originating in Sri Lanka is USD 26.49 per cubic metre, at the exception of the company M/s Merbok MDF Lanka (private) Ltd. whose exports are subject to a duty of USD 11.83 per cubic metre.
This duty is effective for a period of five years.
