In June 2009, the government of Peru imposed a provisional antidumping duty and in October 2009 a definitive duty was imposed. In November 2010, the higher administrative tribunal terminated the duty imposed.

Anti-dumping

On August 31, 2006, the Peruvian National Institute of Antitrust and Intellectual Property Protection (Indecopi) decided to initiate an anti-dumping investigation on imports of white cement from Mexico and produced by Cemex de México S.A. de C.V. (Resolution No. 088-2006/CDS-INDECOPI, 31.08.2006). The product subject to investigation is classified under the following HS code: 2523.2100. The complaint was lodged on June 19, 2006 by Compañía Minera Agregados Calcáreos S.A. The investigation started on the day of the publication of the resolution in the Official Journal El Peruano, i.e. on September 7, 2006. After a provisional anti-dumping duty was imposed on December 18, 2006 (Resolution No. 131-2006/CDS-INDECOPI, 18.12.2006) followed by a definitive anti-dumping duty on May 10, 2007 (Resolution No. 034-2007/CDS-INDECOPI, 10.05.2007), the Antitrust and Intellectual Property Tribunal of the Indecopi decided on June 4, 2008 to nullify Resolution No. 034-2007/CDS-INDECOPI dated May 10, 2007 and the whole investigation leading to this resolution.

On October 27, 2008, the Peruvian National Institute of Antitrust and Intellectual Property, taking into account the ruling of the Antitrust and Intellectual Property Tribunal relaunched the anti-dumping investigation on imports of white cement from Mexico and produced by Cemex de México S.A. de C.V. (Resolution No. 174-2008/CFD-INDECOPI, 27.10.2008).

On June 5, 2009, the Peruvian authorities decided to impose a provisional anti-dumping duty on imports of white cement from Mexico and produced by Cemex de México S.A. de C.V. (Resolution No. 093-2009/CFD-INDECOPI, 05.06.2009). The amount of this provisional duty is USD 68 per metric ton. This provisional anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal El Peruano, i.e. on June 21, 2009.

On September 21, 2009, the Peruvian authorities decided to impose a definitive anti-dumping duty on imports of white cement from Mexico and produced by Cemex de México S.A. de C.V. (Resolution No. 159-2009/CFD-INDECOPI, 21.09.2009). The amount of the definitive duty is USD 62 per metric ton. This definitive anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal El Peruano, i.e. on October 16, 2009.

On 29 November 2010, the Peruvian higher administrative tribunal terminated the definitive duty imposed on imports of the subject good from Mexico.
