ANNOUNCEMENT 12 Mar 2010

In March 2010, the government of Brazil initiated a new anti-dumping investigation and imposed definitive duties in September 2011. In September 2017 the duty was extended following the conclusion of a sunset review. In July 2018, the definitive duty was temporarily suspended.

Anti-dumping

On March 11, 2010, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate an anti-dumping investigation on imports of coarse salt (not destined for animal nor human consumption), used in the manufacturing process of liquid chlorine, hydrochloric acid, sodium hypochlorite, dichloroethane, caustic soda, sodium chlorate or sodium carbonate, from Chile (Circular No. 7, 11.03.2010). The product subject to investigation is classified under the following HS code: 2501.0019. The complaint was lodged by Salinor - Salinas do Nordeste S. A. on November 24, 2009. The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on March 12, 2010.
 
On September 6, 2011, the Brazilian Ministry of Development, Industry and Foreign Trade decided to impose a definitive anti-dumping duty on imports of coarse salt from Chile (Resolução No. 61, 06.09.2011). The rate of the duty is 35.4%. This definitive duty has entered into force on September 8, 2011 for a period of five years.
 
On July 5, 2013, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade announced the initiation of a new exporter review for the following exporter: Compania Minera Cordillera Chile SCM (CMC) (Circular No. 35, 05.07.2013). The investigation was expected to start on August 1, 2013. On September 12, 2013, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade announced that this new exporter review will start on October 1, 2013 (Circular No. 50, 12.09.2013). On September 12, 2013, the Brazilian Ministry of Development, Industry and Foreign Trade decided to suspend the collection of the definitive anti-dumping duty for the Compania Minera Cordillera Chile SCM (CMC) (Resolução No. 70, 12.09.2013). This suspension has entered into force on October 1, 2013 for a period of six months.
 
On 8 September 2016, the Brazilian authorities initiated a sunset review of the above anti-dumping duty on imports of coarse salt from Chile (Circular No. 56, 08.09.2016). This review follows a petition lodged on 29 April 2016 by Salinor - Salinas do Nordeste S.A.

On 1 September 2017, the Brazilian authorities extended the definitive antidumping duty imposed on imports of the subject good from Chile following the conclusion of the above sunset review. The rate of duty is 35.4% of the CIF value depending on the company. The measure is in force for a period of five years.

On 13 July 2018, the Brazilian authorities suspended the definitive duty on imports of coarse salt from Chile for one year. The duty was suspended due to public interest concerns.
