In December 2008, the government of India imposed a definitive duty following the conclusion of an antidumping investigation. In April 2013, a sunset review was initiated and the definitive duty was extended for a new period in July 2014. In July 2019, the definitive duty was terminated.

Anti-dumping

On July 6, 2007, the Indian authorities initiated an anti-dumping investigation on imports of certain types of rubber chemicals from China and South Korea: MBT, CBS, TDQ, PVI, PX-13(6PPD) and TMT from China and PX-13(6PPD) from South Korea. The products subject to investigation are classified under the following HS codes: 2902, 2907, 2909, 2917, 2921, 2925, 2930, 2933, 2934, 2935, 2942, 3811, 3812 and 3815.

On February 28, 2008, the Indian authorities issued their preliminary findings and recommended the imposition of a provisional anti-dumping duty. This provisional duty was imposed on May 5, 2008 (Notification No. 61/2008-Customs, 05.05.2008). For details about the amount of the duty, see the table in Notification No. 61/2008. This provisional duty is effective upto and inclusive of November 4, 2008.

On October 1, 2008, the Indian authorities issued their final findings and recommended the imposition of a definitive anti-dumping duty. This definitive duty was imposed on December 12, 2008 (Notification No. 133/2008-Customs, 12.12.2008). For details about the amount of the duty, see the table in Notification No. 133/2008. This definitive duty is effective for a period of five years with effect from the date of imposition of the provisional anti-dumping duty, i.e. from May 5, 2008.

On April 30, 2013, the Indian authorities initiated a sunset review of the anti-dumping duty imposed on imports of the above-mentioned rubber chemicals from China and South Korea.

On July 5, 2013, the Indian authorities decided to extend up to and inclusive of May 4, 2014 the definitive anti-dumping duty imposed on December 12, 2008 by Notification No. 133/2008-Customs (Notification No. 16/2013-Customs, 05.07.2013).

On April 29, 2014, the Indian authorities issued their final findings of the sunset review. They recommended the continuation of the existing anti-dumping duty on imports of the above-mentioned rubber chemicals from China and South Korea.

On July 24, 2014, the Indian authorities issued the notification of extension of the anti-dumping duty imposed on imports of rubber chemicals from China and South Korea (Notification No. 35/2014-Customs (ADD), 24.07.2014). The amount of the duty ranges from USD 0.55 to USD 1.84 per kilogram, depending on the exact characteristics of the good and on the producing/exporting company. For details about the amount of the duty, see Table 1 of Notification No. 35/2014-Customs (ADD). This duty is effective for a period of five years.

On 23 July 2019, the Indian authorities terminated the definitive duty imposed on imports of the subject good from the Republic of Korea and China. The duty was terminated as it was set to expire after a period of five years unless extended.
