Anti-dumping

On April 25, 2013, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce & Industry, initiated a sunset review of the anti-dumping duty imposed on imports of pentaerythritol from Chinese Taipei.
The product subject to investigation is classified under the following HS code: 2905.42.
This review follows the application lodged by M/s Kanoria Chemicals & Industries Limited on behalf of the domestic industry.
While initiating the sunset review, the Indian authorities decided on June 25, 2013 to extend up to April 27, 2014 the existing definitive anti-dumping duty imposed on April 28, 2008 by Notification No. 55/2008-Customs and modified on August 12, 2011 by Notification No. 74/2011-Customs (Notification No. 74/2011-Customs, 12.08.2011). The amount of this duty is INR 24,167 per metric ton (USD 392.461 at the exchange rate of October 6, 2014).
On May 9, 2014, the Indian authorities extended the time for completing the review up to July 24, 2014.
On September 5, 2014, the Indian authorities extended again the time for completing the review up to October 24, 2014.
 
The original anti-dumping duty on imports originating not only in Chinese Taipei but in Canada and Japan as well was decided on October 8, 2002 and imposed on October 31, 2002 (Notification No. 119/2002-Customs, 31.10.2002).
After a first sunset review concerning only imports originating in Chinese Tapei and Japan that ended on March 5, 2008, it was then extended for five more years for imports originating in those two countries on April 28, 2008 (Notification No. 55/2008-Customs, 28.04.2008).
On June 22, 2010, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce & Industry, initiated a mid-term review of the duty on imports originating in Chinese Taipei imposed on April 28, 2008.
On June 17, 2011, the Indian Directorate General of anti-dumping & allied duties, Ministry of Commerce & Industry, issued its final findings of the mid-term review. It came to the conclusion that the anti-dumping measure imposed on imports originating in Chinese Taipei should be enhanced.
On August 12, 2011, the Indian Ministry of Finance issued the Customs Notification modifying Notification No. 55/2008-Customs dated 28.04.2008. The amount of the duty imposed on imports originating in Chinese Taipei was raised from INR 9,220 (USD 150.052 at the exchange rate of October 6, 2014) to INR 24,167 (USD 392.461 at the exchange rate of October 6, 2014) per metric ton, i.e. increased by around 162%.
