Anti-dumping

On May 5, 2009, the Indian authorities initiated an anti-dumping investigation on imports of Digital Versatile Disc (DVD) of all kinds from Malaysia, Thailand and Vietnam.
The products subject to investigation are classified under HS code subheading 8523.
The complaint was lodged by M/s Optical Disc Manufacturers Welfare Association on behalf of the domestic industry.

On November 13, 2009, the Indian authorities issued their preliminary findings and recommended the imposition of a provisional anti-dumping duty. This provisional duty was imposed on April 12, 2010 (Notification No. 48/2010-Customs, 12.04.2010). The amount of the duty imposed on imports originating in Vietnam is USD 49.25 per 1,000 pieces, at the exception of the company M/s Ritek Vietnam Co. Ltd. whose exports are subject to a duty of USD 31.90 per 1,000 pieces. The amount of the duty imposed on imports originating in Thailand is USD 25.98 per 1,000 pieces. The amount of the duty imposed on imports originating in Malaysia is USD 35.92 per 1,000 pieces.

On July 2, 2010, the Indian authorities issued their final findings and recommended the imposition of a definitive anti-dumping duty. This definitive duty was imposed on September 28, 2010 (Notification No. 98/2010-Customs, 28.09.2010). The amount of the duty imposed on imports originating in Vietnam is USD 50.51 per 1,000 pieces, at the exception of the company M/s Ritek Vietnam Co. Ltd. whose exports are subject to a duty of USD 29.75 per 1,000 pieces. The amount of the duty imposed on imports originating in Thailand is USD 25.98 per 1,000 pieces. The amount of the duty imposed on imports originating in Malaysia is USD 35.92 per 1,000 pieces.
This definitive duty is effective for a period of five years with effect from the date of imposition of the provisional anti-dumping duty, i.e. from April 12, 2010.

On August 16, 2012, the Indian authorities initiated a mid-term review concerning imports originating in Vietnam.
The complaint was lodged by M/s Storage Media Products Manufacturers & Marketers Welfare Association. They have claimed that the circumstances that were prevalent during the period of investigation of the original investigation have changed significantly leading to a situation when anti dumping duty on imports of subject goods from Vietnam is lower than the dumping margin and injury margin that is prevailing at present.

On October 15, 2013, the Indian authorities issued their final findings of the mid-term review and recommended a modification of the duty imposed on imports from Vietnam. This modification was imposed on December 31, 2013 (Notification No. 34/2013-Customs (ADD), 31.12.2013). The amount of the modified duty imposed on imports originating in Vietnam is now USD 73.01 per 1,000 pieces.

On March 27, 2015, the Indian authorities initiated a sunset review of the above-mentioned anti-dumping duty imposed on imports of DVD of all kinds from Thailand and Vietnam.
This follows the application lodged by M/s Moser Baer India Ltd.
The sunset review does not concern Malaysia since there have been no imports of the subject goods from Malaysia during the last three years.

On April 11, 2015, the Indian authorities issued the notification of provisional extension of the anti-dumping duty imposed by Notification No. 98/2010-Customs dated 28.09.2010 (Notification No. 12/2015-Customs (ADD), 11.04.2015). This duty remains into force upto and inclusive of April 11, 2016.
As far as Malaysia is concerned, the duty expired on April 11, 2015.
 
On 13 May 2016, following the conclusion the above-mentioned sunset review the Indian Ministry of Finance issued the Customs Notification extending the definitive anti-dumping duty (Notification No. 17/2016-Customs (ADD), 13.05.2016). The amount of the duty imposed on imports originating in or exported from Viet Nam is USD 41.35 per 1,000 pieces. The amount of the duty imposed on imports originating in or exported from Thailand is USD 43.7 per 1,000 pieces. This definitive duty is effective for a period of five years.
