Labour market access

On 27 July 2010, the Congress of New Caledonia approved a law relative to the protection, promotion and support of local employment.
According to the law, preferential treatment must be given to locals when a job vacancy is posted. In case no local is available to fulfill the position, preferential treatment must be given to residents of New Caledonia, with preference for the ones having permit of stay of greater length. Employers can only hire foreign workers in case that no Caledonian citizen or resident applied for the available position. Exceptions to this rule are documented in a list published on 9 January 2012.
The law also established a Joint Committee for local employment. The latter must verify that whenever an employer wants to hire a foreigner, the preference criterion has been respected. The members of the Commission were appointed on 14 February 2012.
