In May 2011, the government of India initiated a sunset review and extended the definitive antidumping duty in August 2012. A sunset review was initiated in August 2017. In November 2017, the duty was terminated.

Anti-dumping

On May 30, 2011, the Indian authorities initiated a second sunset review of the anti-dumping duty imposed on imports of metronidazole (an anti-diarrhea and anti-microbial drug) from China.
The product subject to investigation is classified under the following HS code: 2933.2920.
On June 29, 2012, the Indian authorities issued their final findings of the sunset review. They recommended the continuation of the existing anti-dumping measure.
On August 30, 2012, the Indian authorities issued the notification of extension of the anti-dumping duty imposed on imports of metronidazole from China (Notification No. 40/2012-Customs (ADD), 30.08.2012). The amount of the duty is USD 2.57 per kilogram, at the exception of the company M/s Hubei Hongyuan Pharmaceutical Co. Ltd. whose exports are subject to a duty of USD 1.49 per kilogram. This duty is effective for a period of five years.
The original anti-dumping duty was decided on July 14, 2000 and imposed by Notification No. 115/2000-Customs on August 31, 2000.
A first sunset review was already initiated on April 8, 2005 and terminated on April 5, 2006 with the continuation of the duty. The extended duty was imposed by Notification No. 61/2006-Customs on June 15, 2006. For details about the amount of the duty, see table of Notification No. 61/2006-Customs.

On 29 August 2017, the Indian authorities initiated a sunset review of the definitive antidumping duty imposed on imports of the subject good from China. This follows the application lodged by Aarti Drugs Ltd and the Order issued by the Hon’ble High Court. 

On 29 August 2017, the Indian Ministry of Finance, Department of Revenue issued the Customs Notification extending the definitive antidumping duty until and including 28 August 2018.

On 9 November 2017, the Indian Directorate General of Anti-dumping & Allied Duties, Ministry of Commerce and Industry terminated the above sunset review following the order of the Hon'ble High Court.

On 17 January 2018, the Indian Ministry of Finance, Department of Revenue rescinded notification No. 40/2012-Customs (ADD) of 30 August 2012. Duties paid after 29 August 2017 are refunded to the relevant parties.
