Anti-dumping

On August 23, 2012, the Mexican Ministry of Economy decided to initiate an anti-dumping investigation on imports of ceramic and porcelain dishware and loose articles from China. The products subject to investigation are classified under the following HS codes: 6911.1001 and 6912.0001. The complaint was lodged on June 6, 2012 by Cinsa S.A. de C.V. The investigation started on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on August 31, 2012.

On April 4, 2013, the Mexican authorities decided to impose a provisional anti-dumping duty on imports of ceramic and porcelain dishware and loose articles from China. The amount of this provisional duty is the difference between the declared customs value and the reference price of USD 2.58 per kilogram in case the declared customs value of imports from China is lower than this reference price. In case the declared customs value of imports from China is equal to or higher than this reference price, no duty is charged. This provisional anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on May 3, 2013.

On December 20, 2013, the Mexican authorities decided to impose a definitive anti-dumping duty on imports of ceramic and porcelain dishware and loose articles from China. The amount of this definitive duty is the difference between the declared customs value and the reference price of USD 2.61 per kilogram in case the declared customs value of imports from China is lower than this reference price. In case the declared customs value of imports from China is equal to or higher than this reference price, no duty is charged. This definitive anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on January 14, 2014.

On 20 December 2018, the Mexican authorities initiated a sunset review of the definitive antidumping duty imposed on imports of the subject good from China. This follows the request lodged on 17 October and 21 November 2018 by Cinsa, S.A. de C.V. and José Julio González Landeros. The definitive antidumping duty will remain in force for the duration of the review. The review commenced on the day following the publication of the resolution in the Official Journal of the Federation i.e. 21 December 2018.
