Ministry of Commerce of the People's Republic of China, MOFCOM Announcement No. 28 of 2015, 17.08.2015, Chinese Version:
Ministry of Commerce of the People's Republic of China, MOFCOM Announcement No. 30 of 2017, 28.06.2017, Announcement on the Termination of Anti-dumping Measures Imposed on Epichlorohydrin Imports from Russia, Republic of Korea, Japan and the U.S.: http://english.mofcom.gov.cn/article/policyrelease/buwei/201706/20170602601410.shtml
On 28 June 2012, the Ministry of Commerce of the People's Republic of China (MOFCOM) has extended anti-dumping duties on epichlorohydrin (ECH) from the US, Japan, Republic of Korea and Russia for the period of five years.
On 28 June 2006, the MOFCOM announced to levy anti-dumping duties on ECH from the US, Japan, Republic of Korea and Russia for a period of five years. Before the termination of duties, on April 13, 2011, four Chinese companies (on behalf of the Chinese ECH industry) submitted an application to the MOFCOM for the conduction of a final review investigation. The MOFCOM initiated the investigation on June 27, 2011. With Notice NO.32 (2012) the MOFCOM concludes that a causal link between the injury of the Chinese ECH industry and dumping from companies in the US, Japan, the Republic of Korea and Russia exists.
On August 17th, 2015, the Ministry of Commerce of the People's Republic of China decided to reduce the rate of the anti-dumping duty imposed on exports of the US company Blue Cube Operations LLC from the general rate of 71.5% to the reduced rate of 4.3% that already applied to exports of the US company The Dow Chemical Company.
This decision follows the application lodged on June 16th, 2015 by Blue Cube Operations LLC. Indeed, after the acquisition of this company by The Dow Chemical Company, all business activities of The Dow Chemical Company concerning epichlorohydrin were transferred to its new subsidiary Blue Cube Operations LLC. Therefore this company is now granted the preferential rate that used to apply to operations of The Dow Chemical Company.
Following this decision, any export that continues to be under the name of The Dow Chemical Company is no longer granted the preferential treatment (since it is supposed that all business is now operated by Blue Cube Operations LLC) and is subject to the general duty at a rate of 71.5%.
This modification entered into force on September 1st, 2015.
On 28 June 2017, the Ministry of Commerce of the People's Republic of China terminated the definitive antidumping duty on imports of the subject good from the United States, Japan, Republic of Korea and Russia.
