The Argentine Government has adopted new legislation defining the capital goods that are exempted from the statistical fee as long as they are imported to be used in non-conventional oil and gas projects.

Internal taxation of imports

On 29 October 2019, the Argentine Ministry of Production and Labour together with the Secretariat for Energy of Argentina have adopted Joint Resolution 2/2019, establishing the list of capitals goods exempted from the statistical fee set on imports.

This list results from the announcement made in Decree 361/2019 of 17 May 2019, were the Executive stated that capital goods used in non-conventional oil and gas projects would be exempted from this tax (please, see related state acts).

As a result of the new legislation, 93 eight-digits tariff lines have been exempted from the 2.5% statistical fee until 31 December 2019.

Joint Resolution has entered into force on 2 November 2019.

On 27 December 2019, the Argentine Executive adopted Decree 99/2019 extending until 31 December 2020 the statistical fee exemption set on the 93 eight-digits tariff lines announced on Joint Resolution 2/2019. The new legislation also modified the applicable statistical fee set on other goods (please, see related state acts).

Tax or social insurance relief

The list of capitals goods exempted from the statistical fee set on imports introduced by Joint Resolution 2/2019 adopted by the Argentine Ministry of Production and Labour together with the Secretariat for Energy of Argentina on 29 October 2019, also imply the approval of a tax-exemption applicable to companies involved in non-conventional oil and gas extraction.

On 27 December 2019, the Argentine Executive adopted Decree 99/2019 extending the application of Joint Resolution 2/2019.
