Safeguard

On December 26th, 2012, the Vietnamese authorities initiated a safeguard investigation on imports of refined soya-bean oil, RBD palm olein oil and RBD palm stearin oil.
The products subject to investigation are classified under the following HS codes: 1507.9090, 1511.9091, 1511.9092 and 1511.9099.
This follows the application lodged on November 30th, 2012 by the National Company for Vegetable Oils, Aromas and Cosmetics of Vietnam (VOCARIMEX).
According to the UN Comtrade Database, in 2011 the following countries exported goods classified under HS code subheadings 1507.90 and 1511.90 to Viet Nam with a trade value over the GTA threshold of USD 1 million: Malaysia, Indonesia and Thailand.
 
On May 10th, 2013, the Vietnamese authorities notified to the WTO their decision to impose a provisional safeguard duty on imports of vegetable oils. The rate of the duty is 5%.
Even if identified as potential affected trading partner according to the GTA methodology, Thailand belongs to the list of countries that are excluded from the investigation.
This measure should remain in force for a period not exceeding 200 days.
 
On September 10th, 2013, the Vietnamese authorities notified to the WTO their decision to impose a definitive safeguard duty on imports of vegetable oils. The rate of the duty is 5% during the first year (starting on May 7th, 2013), 4% during the second year, 3% during the third year and 2% during the fourth and last year (until May 6th, 2017).
Even if identified as potential affected trading partner according to the GTA methodology, Thailand belongs to the list of countries that are excluded from the application of the definitive measure.
This measure should remain in force for a period of four years.
 
In May 2015, the Vietnamese authoritied initiated a review of the above-mentioned safeguard measure.
 
On August 10th, 2015, the Vietnamese authorities concluded the review initiated in May 2015 and decided upon the continuation without modification of the safeguard measure notified to the WTO on September 10th, 2013.
