Controls on commercial transactions and investment instruments

On 12 July 2019, the Securities and Exchange Commission of Myanmar (SECM) through Notification No. 1/2019 permitted foreign participation in daily share trading of listed companies on the Yangon Stock Exchange (YSX).

The Notification has defined a foreigner as - 

  • an individual who is not a citizen, an associate citizen or a naturalized citizen under the Myanmar Citizenship Law
  • a company or an institution that is formed in the Republic of the Union of Myanmar under any existing law or a company or an institution formed outside the Union under any law including a law of a jurisdiction other than the Union

The companies listed on the YSX have to notify YSX in advance about the percentage of foreign ownership allowed in their companies and ensure that YSX has received approval for the same from the SECM. The YSX will obtain the necessary permission from the SECM, notify the conditions for foreign participation and investments, and announce the date on which foreigners may start trading of listed companies.
