Anti-dumping

On April 30, 2019 Hirsh Industries LLC filed a petition seeking the imposition of AD and CVD orders against vertical metal file cabinets from China. The merchandise subject to the investigation is classified under harmonized Tariff System of the United States category 9403.10.0020. 

On June 13, 2019 the U.S. International Trade Commission (USITC) determined that there is a reasonable indication that a U.S. industry is materially injured by reason of imports of vertical metal file cabinets from China that are allegedly subsidized and sold in the United States at less than fair value. 

On July 25, 2019 the U.S. Department of Commerce announced the affirmative preliminary determinations in the antidumping countervailing duty investigations of imports of vertical metal file cabinets from China, finding that exporters received antidumping duty rates of 198.50 percent and countervailable subsidies of 227.10 percent. Based on these preliminary determinations, the Department of Commerce will instruct U.S. Customs and Border Protection to collect cash deposits from importers of vertical metal file cabinets from China based on these preliminary rates.

On October 8, 2019, the Department of Commerce announced its affirmative final determinations. No companies responded to requests for information in the AD investigation. The final AD rate is 198.5 percent for all Chinese producers and exporters. .  

On November 8, 2019 the U.S. International Trade Commission (USITC) determined that a U.S. industry is materially injured by reason of imports of vertical metal file cabinets from China. As a result of the determinations, Commerce will issue antidumping and countervailing duty orders on imports of this product from China.

Accordingly, the final subsidy rate for all Chinese producers and exporters is 271.79 percent.
