ANNOUNCEMENT 02 Jun 2011

In June 2011, the government of Turkey initiated a sunset review and extended the definitive antidumping duty in March 2012. The definitive duty is extended to imports from Malaysia, Indonesia, Pakistan, the Philippines and Vietnam following the conclusions of anti-circumvention investigations. In 2017, a sunset review was initiated.

Anti-dumping

On June 2, 2011, the Turkish authorities initiated a sunset review of the anti-dumping duty imposed on imports of wall-type split air conditioners, and their indoor/outdoor units, from China (Notification 2011/10).
The products subject to investigation are classified under the following HS codes: 8415.1090 and 8415.9000.

On March 21, 2012, the Turkish authorities decided upon the continuation for a period of five years of the anti-dumping measure imposed on imports of the above-mentioned products originating in China (Notification 2012/6). The rate of the duty is 25% of the CIF value.

The original anti-dumping duty was imposed on July 26, 2006 (Notification 2006/20).
 
On 21 March 2017, the Turkish authorities initiated a sunset review of the anti-dumping measure imposed on imports of the subject good from China. The investigation follows the application lodged by Arçelik-LG Klima San. and Tic. A.S. ve Vestel Beyaz Esya San. ve Tic. A.S.

Anti-circumvention

On July 25, 2009, the Turkish authorities initiated an anti-circumvention investigation on imports of wall type split air conditioners and their indoor/outdoor units from Egypt, Indonesia, Pakistan, the Philippines and Vietnam (Notification 2009/26). This investigation follows suspicion that the definitive anti-dumping duty imposed on imports of the above-mentioned products from China might be circumvented (see related intervention). The products subject to investigation are classified under the following HS codes: 8415.1090, 8415.81 and 8415.82.

On January 4, 2011, the Turkish authorities imposed a definitive anti-dumping duty on imports of wall type split air conditioners from Indonesia, Pakistan, the Philippines and Vietnam. The rate of this definitive duty is 25% of the CIF value. No anti-dumping duty was imposed on imports originating in Egypt since circumvention was not determined.

On 2 June 2011, the Turkish authorities initiated a sunset review of the antidumping duty imposed on imports of wall-type split air conditioners, and their indoor/outdoor units, from China (Notification 2011/10). Since the anti-dumping measure imposed on imports of subject good from China was extended to imports of the same products originating in Indonesia, Pakistan, the Philippines and Viet Nam the sunset review and its conclusion will hold for these countries as well.

On 21 March 2017, the Turkish authorities initiated a sunset review of the antidumping duty imposed on imports of wall-type split air conditioners, and their indoor/outdoor units, from China. Since the anti-dumping measure imposed on imports of subject good from China was extended to imports of the same products originating in Indonesia, Pakistan, the Philippines and Viet Nam the sunset review and its conclusion will hold for these countries as well.

Anti-circumvention

On January 12, 2008, the Turkish authorities initiated an anti-circumvention investigation on imports of wall type split air conditioners and their indoor/outdoor units (except for outdoor unit of VRF systems) from Malaysia (Notification 2008/3). This investigation follows suspicion that the definitive anti-dumping duty imposed on imports of the above-mentioned products from China might be circumvented (see related intervention).
The products subject to investigation are classified under the following HS codes: 8415.1090 and 8415.9000.
On June 14, 2008, the Turkish authorities imposed a provisional anti-dumping duty on imports of the above-mentioned products from Malaysia (Notification 2008/20). The rate of this provisional duty is 25% of the CIF value, with the exception of the companies Panasonic Air Conditioning (M) Sdn Bhd/Malezya, O.Y.L. Manufacturing Sdn. Bhd./Malezya and Hitachi Air Conditioning Products Sdn Bhd (Hitachi)/Malezya whose products are not subject to the payment of a duty. This duty entered into force 10 days after the publication of Notification 2008/20 in the Turkish Official Gazette, i.e. on June 24, 2008.
On February 28, 2009, the Turkish authorities imposed a definitive antidumping duty on imports of wall type split air conditioners from Malaysia. The rate of this definitive duty is 25% of the CIF value, with the exception of the companies Panasonic Air Conditioning (M) Sdn Bhd/Malezya, O.Y.L. Manufacturing Sdn. Bhd./Malezya and Hitachi Air Conditioning Products Sdn Bhd (Hitachi)/Malezya whose products are not subject to the payment of a duty.
