Anti-dumping

On 9 July 2012, the Brazilian authorities initiated an anti-dumping investigation on imports of nylon yarn from China, the Republic of Korea, Thailand and Chinese Taipei. The products subject to investigation are classified under the following HS code subheadings: 5402.31.11, 5402.31.19 and 5402.45.20. This follows the application lodged by the Brazilian enterprise Rhodia Poliamidas e Especialidades Ltda.

On 16 September 2013, the Brazilian authorities imposed a provisional duty on imports of the subject good from China, Chinese Taipei and Thailand. The rate of duty on imports from China is between USD 96.18 and 2,409.11 per tonne. The rate of duty on imports from Chinese Taipei is between USD 220.70 and 286.26 per tonne. The rate of duty on imports from Thailand is USD 911.64 per tonne. The Republic of Korea is not subject to provisional duties.

On 27 December 2013, the Brazilian authorities imposed a definitive duty on import of the subject good from China, Chinese Taipei, the Republic of Korea and Thailand. The rate of duty on imports from China is between USD 334.78 and 2,409.11 per tonne. The rate of duty on imports from the Republic of Korea is between USD 156.32 and 3,224.91 per tonne. The rate of duty on imports from Chinese Taipei is between USD 282.97 and 1,629.18 per tonne. The rate of duty on imports from Thailand is USD 1,146.73 per tonne. The measure is in force for a period of five years.

On 24 December 2018, the Brazilian authorities initiated a sunset review of the definitive antidumping duty imposed on imports of the subject good from China, the Republic of Korea, Thailand and Chinese Taipei. This follows the application lodged on 27 September 2018 by the Associação Brasileira de Produtores de Fibras Artificiais e Sintéticas - ABRAFAS. The duty will remain in force for the duration of the review.

On 14 March 2019, the Brazilian authorities revoked the decision made on 24 December 2018 to initiate a sunset review as so far as it relates to Thailand. The sunset review remains in progress for the remaining affected jurisdictions i.e. China, the Republic of Korea and Chinese Taipei. The definitive duty is thereby terminated on imports from Thailand as the duty imposed in December 2013 was in force for a period of five years.
