Anti-dumping

On June 24, 2011, the South African authorities initiated an anti-dumping investigation on imports of frozen chicken meat (whole bird and boneless cuts) from Brazil (Notice No. 404 of 2011, 24.06.2011).
The products subject to investigation are classified under the following HS codes: 0207.1290 and 0207.1410.
The application was lodged by the South African Poultry Association, on behalf of major producers of the subject products in the Southern African Customs Union.
The dumping is suspected to have occurred between January 1, 2010 and December 31, 2010.
On February 10, 2012, the South African authorities imposed a provisional anti-dumping duty on imports of frozen chicken meat from Brazil. The rate of the duty imposed on whole bird products (HS code 0207.1290) is 62.93%. The rate of the duty imposed on boneless cuts (HS code 0207.1410) is 46.59%, at the exception of the company Coperativa Central Oeste Catarinense - Aurora Alimentos whose exports are subject to a duty of 6.26%.
After having completed the investigation, the International Trade Administration Commission of South Africa made a final determination that dumping was taking place and therefore recommended to the Minister of Trade and Industry that a definitive anti-dumping duty on imports of frozen chicken meat from Brazil be imposed. On March 8, 2013, the South African Trade Minister rejected the Commission's recommendation and decided not to impose a definitive duty (Notice No. 173 of 2013, 08.03.2013).
