In April 2010, the government of Mexico initiated a new anti-dumping investigation and a definitive duty was imposed in March 2012. The duty was terminated in January 2018.

Anti-dumping

On August 23, 2010, the Mexican Ministry of Economy decided to initiate an anti-dumping investigation on imports of graphite electrodes for electric arc furnace from China (Resolución por la que se acepta la solicitud de parte interesada y se declara el inicio de la investigación anti-dumping sobre las importaciones de electrodos de grafito para horno de arco eléctrico..., 23.08.2010).
The products subject to investigation are classified under the following HS code: 8545.1101.
The complaint was lodged on April 30, 2010 by GrafTech México S.A. The investigation started on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on September 2, 2010.
On May 24, 2011, the Mexican authorities decided to impose a provisional anti-dumping duty on imports of graphite electrodes from China (Resolución preliminar de la investigación anti-dumping sobre las importaciones de electrodos de grafito para horno de arco eléctrico..., 24.05.2011). The rate of this provisional duty was 23% for all Chinese exporters. This provisional anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on June 1, 2011.
On February 22, 2012, the Mexican authorities decided to impose a definitive anti-dumping duty on imports of graphite electrodes from China (Resolución final de la investigación anti-dumping sobre las importaciones de electrodos de grafito para horno de arco eléctrico..., 22.02.2012). The rate of this definitive duty ranges from 38% to 250%, depending on the Chinese exporter. This definitive anti-dumping duty has entered into force on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on March 2, 2012.

On March 20, 2013, the Mexican authorities decided to amend the definitive anti-dumping duty imposed on February 22, 2012. The rate of this duty still ranges from 38% to 250%, depending on the Chinese exporter. However the specific rate for one particular Chinese exporter, namely Jilin Carbon Import and Export Company, was modified within those upper and lower limits, the rate charged on exports of this particular company being reduced from 68% to 42% (Resolución por la que se resuelve el recurso administrativo de revocación interpuesto por las empresas Jilin Carbon Import and Export Company, Sichuan Guanghan Shida Carbon Co. Ltd. y Nantong Yangzi Carbon Co. Ltd. ..., 20.03.2013).
This decision followed a request for the revocation of the resolution imposing the definitive duty lodged by three Chinese exporters on May 8, 2012. This change has entered into force on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on April 4, 2013.
 
On 21 February 2017, the Mexican Ministry of Economy initiated a sunset review of the anti-dumping duty imposed on imports of the subject good from China. This review follows the request lodged on 6 December 2016 by GrafTech México, SA de CV. The existing anti-dumping measure remains in force during the review. A sunset review was also initiated on the anti-dumping duty imposed on the subject good from the United Kingdom, see related intervention.

On 15 January 2018, the Mexican authorities terminated the definitive duty imposed on imports of the subject good from China following the conclusion of the above sunset review. The definitive duty imposed on imports of the same good from the United Kingdom was also terminated, see related intervention.

Anti-circumvention

 

On July 28, 2014, the company GrafTech México, S.A. de C.V. lodged a request for an investigation to ascertain the existence of circumventing practices that would challenge the definitive anti-dumping duty imposed on February 22, 2012 (and amended on March 20, 2013) on imports of graphite electrodes originating in China (see related intervention).
The petitioner argued that since September 2012 imports of graphite electrodes from the United Kingdom (particularly from the exporting company U.K. Carbon and Graphite, Co. Ltd.) have increased in order to avoid the payment of the aforementioned anti-dumping duty. According to the petitioner, graphite rods are exported from China to the UK and are then transformed into graphite electrodes through a light manufacturing process taking place in the UK, to in the end be exported to Mexico without having to pay any anti-dumping duty.
On November 6, 2014, the Mexican Ministry of Economy decided to initiate an investigation on the circumvention of the anti-dumping duty imposed on imports of graphite electrodes originating in China. Those goods are classified under the following HS code: 8545.1101. The investigation started on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on December 4, 2014.

On August 13th, 2015, the Mexican Ministry of Economy concluded the investigation and decided upon the extension of the anti-dumping measure imposed on imports of graphite electrodes from China to imports of the same products from the United Kingdom of Great Britain and Northern Ireland (when manufactured with graphite rods originating in China) as far as the company U.K. Carbon and Graphite, Co. Ltd. is concerned.
The rate of the duty is the rate that applies to the Chinese company that supplies the graphite rods that are then used in the United Kingdom to manufacture graphite electrodes.
This definitive duty entered into force on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on September 2nd, 2015.
