Anti-dumping

On May 26, 2011, the Peruvian authorities decided, after having conducted an expiry review, the continuation of the anti-dumping duty imposed on imports of cotton and polyester-cotton blends (unbleached, bleached or dyed), colourful, weighing more than 170 g/m2, made of carded and/or combed cotton yarns, from China (Resolution No. 061-2011/CFD-INDECOPI, 26.05.2011).
The products subject to the duty are classified under the following HS codes: 5208.12, 5208.13, 5208.19, 5208.22, 5208.23, 5208.29, 5208.32, 5208.33, 5208.39, 5209.11, 5209.12, 5209.19, 5209.21, 5209.22, 5209.29, 5209.31, 5209.32, 5209.39 and 5514.21.
The amount of the duty depends on the FOB price declared by the exporter. For a FOB price lower than USD 3.710 per kilogram, the amount of the duty is USD 0.435 per kilogram. For a FOB price of at least USD 3.740 but less than USD 4.175 per kilogram, the amount of the duty is the difference between 4.175 and the FOB price declared. For a FOB price of at least USD 4.175 per kilogram, the amount of the duty is 0. This definitive anti-dumping duty entered into force on the day of the publication of the resolution in the Official Journal El Peruano, i.e. on June 4, 2011, and is applicable for a period of three years.
This duty follows an expiry review requested on March 9, 2010 by Tejidos San Jacinto S.A., Compañía Industrial Nuevo Mundo S.A. and the National Industries Society (Sociedad Nacional de Industrias - SNI). A review was then initiated by the Peruvian National Institute of Antitrust and Intellectual Property Protection (Indecopi) on July 22, 2010 (Resolution No. 131-2010/CFD-INDECOPI, 22.07.2010). Resolution No. 131-2010 was published in the Official Journal El Peruano on July 28, 2010.
The original anti-dumping duty was decided on October 24, 2005 (Resolution No. 150-2005/CDS-INDECOPI, 24.10.2005). This resolution was published in the Official Journal El Peruano on November 11, 2005.
 
On May 23, 2014, the Peruvian authorities announced that the anti-dumping duty imposed by Resolution No. 061-2011/CFD-INDECOPI dated 26.05.2011 will terminate on June 4, 2014 (Resolution No. 058-2014/CFD-INDECOPI, 23.05.2014).
