Anti-dumping

On September 28, 2017 the Chemours Company FC LLC filed a petition seeking the imposition of antidumping duties on polytetrafluoroethylene (PTFE) resin imported from China and India. PTFE is classified in the Harmonized Tariff Schedule of the United States (HTSUS) under subheadings 3904.61.0010 and 3904.61.0090. Subject merchandise may also be classified under subheading 3904.69, HTSUS.

On November 9, 2017 the U.S. International Trade Commission (USITC) determined that there is a reasonable indication that a U.S. industry is materially injured by reason of these imports.

On May 1, 2018, the Department of Commerce announced its affirmative preliminary determinations. In the China investigation, Commerce assigned a preliminary dumping rate of 84.75 percent for Daikin Fluorochemicals (China) Co., Ltd. Commerce assigned a preliminary dumping rate of 69.34 percent for Shandong Dongyue Polymer Material Co., Ltd. All other producers/exporters in China that are eligible for a separate rate received a rate of 78.74 percent. All other producers/exporters in China that are not eligible for a separate rate received the China-wide rate of 208.16 percent, based on adverse facts available. In the India investigation, Commerce assigned a preliminary dumping rate of 18.49 percent for Gujarat Fluorochemicals Limited, the sole mandatory respondent in this investigation. Commerce assigned a preliminary dumping rate of 18.49 percent for all other producers and exporters of PTFE resin from India. As a result of the preliminary affirmative determinations, Commerce will instruct U.S. Customs and Border Protection (CBP) to require cash deposits based on these preliminary rates.

On September 20, 2018, the Department of Commerce announced its affirmative final determinations. In the China investigation, Commerce assigned a dumping rate of 91.65 percent for Daikin Fluorochemicals (China) Co., Ltd. Commerce assigned a dumping rate of 54.41 percent for Shandong Dongyue Polymer Material Co., Ltd. All other producers/exporters in China that are eligible for a separate rate received a rate of 77.13 percent. All other producers/exporters in China that are not eligible for a separate rate received the China-wide rate of 218.88 percent, based on adverse facts available. In the India investigation, Commerce assigned a dumping rate of 22.78 percent for Gujarat Fluorochemicals Ltd., the sole mandatory respondent in this investigation. Commerce assigned a dumping rate of 22.78 percent for all other producers and exporters of PTFE resin from India.

On October 31, 2018 the USITC determined that a U.S. industry is not materially injured or threatened with material injury by reason of imports of PTFE resin from China and India that the U.S. Department of Commerce has determined are sold in the United States at less than fair value. As a result of the USITC’s negative determinations, no antidumping duty orders will be issued on imports of this product from China and India.

PTFE is classified in the Harmonized Tariff Schedule of the United States (HTSUS) under subheadings 3904.61.0010 and 3904.61.0090. Subject merchandise may also be classified under subheading 3904.69, HTSUS.

On November 9, 2017 the U.S. International Trade Commission determined that there is a reasonable indication that a U.S. industry is materially injured by reason of these imports. On June 22, 2018, however, the commission determined that a U.S. industry is not materially injured or threatened with material injury by reason of these imports. As a result of the USITC’s negative determination, no countervailing duty order will be issued.
