FDI: Entry and ownership rule

On 3 February 2011, the government of China announced the formation of a ministerial committee to evaluate mergers and acquisitions with respect to the national interest. Foreign investment maybe rejected on grounds of national interest or national security reasons in enumerated industries.
 
These industries are:

  • domestic military-industrial and military-related enterprises,
  • enterprises of key and sensitive military facilities and other units concerning national security;
  • major agricultural products;
  • energy and resources;
  • infrastructure;
  • transportation services, 
  • key technologies and major equipment manufacturing.
