Public procurement localisation

On January 17, 2014, the President signed into law the Consolidated Appropriations Act, 2014 (H.R.3547). The bill includes a provision that restricts foreign access to public procurement tenders of the Department of Defense.

Section 8123 of the Department of Defense Appropriations Act for the Fiscal Year 2014 "Prohibits the use of funds: (1) for the purchase or manufacture of U.S. flags unless such flags are treated as covered items under Buy American requirements".

In addition, sections 8024 and 8034 of that Act require the Department of Defense to follow Buy American requirement in the "procurement of carbon, alloy, or armor steel plating" and "Prohibit the use of funds: (1) by a DOD entity without compliance with the Buy American Act", respectively. However, those public procurement restrictions were implemented already in previous appropriation bills. Hence, only flags have been selected as affected products in this intervention.
