ANNOUNCEMENT 26 Jun 2017

In June 2017, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade initiated an antidumping investigation on imports of nitrile rubber (NBR) from France and the Republic of Korea. In March 2018, a provisional duty was imposed and a definitive duty was imposed in August 2018.

Anti-dumping

The antidumping investigation was initiated on 26 June 2017. The products subject to investigation are classified under the following HS code subheading: 4002.59.00. This investigation follows the application lodged on 28 April 2017 by Nitriflex S.A. Indústria e Comércio. Notably, a similar proceeding was initiated in 2010 following the application lodged by the same company. However, this investigation was terminated without the imposition of duties, see related measure.

On 2 March 2018, the Brazilian authorities imposed a provisional duty on imports of nitrile rubber (NBR) from the Republic of Korea and France. The rate of duty on imports from France is USD 0.64 or 0.75 per kg depending on the company. The rate of duty on imports from the Republic of Korea is USD 0.23 or 0.45 per kg depending on the company. The duty is in force for a period of six months.

On 13 August 2018, the Brazilian authorities imposed a definitive antidumping duty on imports of the subject good from the Republic of Korea and France. The rate of duty on imports from the Republic of Korea is USD 0.15 or 0.34 per kg. The rate of duty on imports from France is USD 0.65 or 0.92 per kg. The measure is in force for a period of five years.
