The Ministry of Finance allowed the imports of Rapid Transit (metro-rail) project related goods of 11 cities to be cleared as project-related imports under HS 9801, thereby qualifying these imports for a reduced import duty of 5%.

Import tariff

The metro rail projects in 11 Indian cities have been added to the list of projects in the Projects Imports Regulations, 1986. The Regulations provide that projects/plants listed within will be assessed and cleared as project-related imports under HS 9801 even though the imported goods stem from HS chapter 86. Further, as amended by Notification 12/2012-Customs, project-related imports under HS 9801 are subject to a maximum customs duty of 5%.

The project-related imports are assessed within the Projects Imports Regulations only if they pertain to the setting up of a unit or a substantial expansion of an existing unit and are limited to machinery, instruments, apparatus, etc. The Regulations facilitate the importer by allowing grouping of all goods under one tariff head.
