Anti-dumping

On September 9, 2011, the MOFCOM announced the initiation of AD investigation on the Certain High-performance Stainless Steel Seamless Tubes from the EU and Japan. And after the AD investigation period, in accordance with Chinese Anti-dumping Regulations, the MOFCOM released this preliminary determination of AD duty on the said products from the EU and Japan, holding that there exists a causal link between dumping from the EU and Japan and injury of Chinese domestic High-performance Stainless Steel Seamless Tubes industry.
On May 8, 2012, the Ministry of Commerce (MOCOM) of the People's Republic of China released the Notice NO.21 (2012), announcing the preliminary determination of AD duty on Certain High-performance Stainless Steel Seamless Tubes (listed under 73044110 and 73044910 in the import tariffs of the Chinese Customs) from the EU and Japan.
In accordance with Anti-dumping Regulations, the MOFCOM announced this Notice NO. 21 (2012) with levying AD duty by means of cash deposits on relevant EU and Japanese companies ranging from 9.70% to 39.5% and this AD measure shall come into effect since the date of May 9, 2012. Where importing high-performance stainless steel seamless tubes from the EU and Japan, importers shall submit a cash deposit to the Custom of the PRC with applicable cash deposit.
 
On November 8, 2012, the Ministry of Commerce (MOFCOM) of the People's Republic of China issued the Notice No.72 (2012), announcing to impose AD duty on imported certain high-performance stainless steel seamless tubes (HS NO. 73044110, 73044910, 73045110 and 73045910), with AD duty rate varies from 9.2% to 14.4%. This measure will come into effect on November 9, 2012, and will remain in effect for five years, until November 9, 2017.
 
On 20 June 2016, the Ministry of Commerce (MOFCOM) of the People's Republic of China decided to re-investigate the above anti-dumping measure. This follows the ruling by the World Trade Organization's Appellate Body with regards the dispute over "China's anti-dumping measures imposed on the relevant high-performance stainless steel seamless pipes originated from the European Union and Japan".
 
On 22 August 2016, the Ministry of Commerce (MOFCOM) of the People's Republic of China issued Notice No. 34 of 2016 terminating the above anti-dumping measure on imports of certain high-performance stainless steel seamless pipes from the EU and Japan. This follows the original petitioner's submission of an application to cancel the above anti-dumping measures.
