On April 8, 2011, the Government of Brazil adopted anti-dumping duties against lycra from China. The measure consists of an anti-dumping duty of 4.10 dollars per kilogram.
The anti-dumping investigation initiated on November 3, 2009, upon request of the Associação Brasileira da Indústria Têxtil e de Confecção (ABIT) and the Brazilian enterprises Lunelli Têxtil Ltda., Pettenati S.A. Indústria Têxtil, Osasuna Participações Ltda. (Jangadeiro), Santaconstância Tecelagem Ltda. y Vicunha Têxtil S.A.
The products subject to the anti-dumping duties are classified under the following tariff codes of the MERCOSUR Harmonized System: 6004.10.41, 6004.10.42, 6004.10.43, 6004.10.44, 6004.90.40, 6006.41.00, 6006.42.00, 6006.43.00 and 6006.44.00.
On November 3rd, 2009 Brazil decided to initiate an anti-dumping and injury investigation on the imports from China of knitted/crocheted fabrics. The products are classified under items 6004.10.20, 6004.90.20, 6006.90.20, 6006.41.00, 6006.42.00, 6006.43.00 e 6006.44.00 of Mercosur Common Nomenclature (NCM) tariff code.
On 7 April 2016, the Brazilian authorities initiated a sunset review of the above anti-dumping duty on Lycra from China (Circular No. 20, 06.04.2016). This review follows a petition lodged on 28 October 2015 by Associação Brasileira da Indústria Têxtil e de Confecção (ABIT). The existing anti-dumping measure remains in force during the review period.
On 17 February 2017, the Brazilian authorities extended the definitive anti-dumping duty on the subject good from China following the conclusion of a sunset review (Camex Resolution No. 7 of 2017). The rate of duty remains at USD 4.10 per kilogram. The duty is in force for a period of five years.
