Anti-dumping

On January 24, 2011, the Mexican Ministry of Economy decided to initiate an anti-dumping investigation on imports of chicken legs and thighs from the United States of America.
The products subject to investigation are classified under the following HS codes: 0207.1303 and 0207.1404.
The complaint was lodged on July 2, 2010 by Bachoco, S.A. de C.V., Productos Agropecuarios de Tehuacán, S.A. de C.V. and Buenaventura Grupo Pecuario, S.A. de C.V. The investigation started on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on February 9, 2011.

On January 11, 2012, the Mexican authorities issued their preliminary resolution and decided not to impose a provisional anti-dumping duty on imports of chicken legs and thighs originating in the United States of America.

On July 31, 2012, the Mexican authorities decided to impose a definitive anti-dumping duty on imports of chicken legs and thighs originating in the United States of America. The rate of the duty is 127.5%, at the exception of the companies Simmons, Sanderson, Tyson Foods and Pilgrim´s Pride Corporation whose exports are subject to a duty of 25.7%. This definitive anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Federation, i.e. on August 7, 2012.

On 3 August 2017, the Mexican authorities initiated a sunset review of the definitive antidumping duty imposed on imports of the subject good from the United States. This follows the request lodged on 30 June 2017 by Bachoco, S.A. de C.V. The existing antidumping measure remains in force during the review.

On 9 August 2017, the Mexican authorities issued a resolution amending the definitive duty imposed on imports of the subject good from the United States. The duty is amended to 25.7% regardless of the exporting company. The resolution entered into force on 10 August 2017.

On 27 August 2018, the Mexican authorities extended the definitive duty imposed on imports of chicken legs and thighs from the United States of America following the conclusion of the sunset review. The rate of duty is 25.7%. The duty is in force for a period of five years from 7 August 2017.
