In September 2010, the European Commission initiated a new anti-dumping investigation and a definitive duty was imposed in December 2011. In March 2018, the definitive duty was extended for a new period following the conclusion of a sunset review initiated in December 2016.

Anti-dumping

On September 30, 2010 the European Commission initiated an anti-dumping investigation on imports of certain seamless pipes and tubes of stainless steel originating in the People's Republic of China by means of the notice of initiation No. 2010/C 265/09. The investigation was initiated following a complaint lodged on August 16, 2010 by the Defence Committee of the seamless stainless steel tubes industry of the European Union, representing more than 50% of EU production of the product. The product under investigation is classified under the following HS code subheadings: 7304 11 00, 7304 22 00, 7304 24 00, ex 7304 41 00, 7304 49 10, ex 7304 49 93, ex 7304 49 95, ex 7304 49 99 and ex 7304 90 00.

On 30 June 2011 the European Commission imposed provisional anti-dumping duties on imports of certain seamless pipes and tubes of stainless steel from China. The rate of duty is between 48% and 71.5% of the net free-at-Union-frontier price before duty depending on the company. The measure is in force for a period of 6 months.

On 21 December 2011, the European Council imposed a definitive anti-dumping duty on imports of the subject good from China. The rate of duty is between 48.6% and 71.9% of the net free-at-Union-frontier price before duty depending on the company.

On 10 December 2016, the European Commission initiated a sunset review on the anti-dumping duty imposed on imports of the subject good from China. This follows the request lodged on 8 September 2016 by Seamless Stainless Steel Tubes Industry of the European Union.

On 7 March 2018, the European Commission extended the definitive duty imposed on imports of certain seamless pipes and tubes of stainless steel from China. The rate of duty is 48.3% and 71.9% of the net free-at-Union-frontier price before duty depending on the company. The regulation extending the definitive duty was published on 6 March 2018. 

On 3 September 2019, the European Commission issued Commission Implementing Regulation (EU) 2019/1382 amending the definitive duty imposed on imports of certain seamless pipes and tubes of stainless steel from China if a specific safeguard duty is also imposed on the same good. More specifically, in cases when the definitive safeguard duty of 25% out of quota is applied on the subject good (see related state act), the definitive antidumping duty is reduced. The rate of reduced definitive duty on imports is between 23.6% and 46.9% depending on the company. This decision follows a notice issued in April 2019 and following comments from interested parties.

Anti-circumvention

On 18 February 2017, the European Commission initiated an anti-circumvention investigation on imports certain seamless pipes and tubes of stainless steel from India. This investigation follows suspicion that the definitive antidumping duty imposed by Council Implementing Regulation (EU) No 1331/2011 on imports of the same products originating in China might be circumvented (see related measure). The products subject to investigation are classified under the following HS codes: ex 7304 11 00, ex 7304 22 00, ex 7304 24 00, ex 7304 41 00, ex 7304 49 10, ex 7304 49 93, ex 7304 49 95, ex 7304 49 99 and ex 7304 90 00. The investigation follows the application lodged on 3 January 2017 by the Defence Committee of the Seamless Stainless Steel Tubes Industry of the European Union.

On 16 November 2017, the European Commission terminated the anti-circumvention investigation on imports certain seamless pipes and tubes of stainless steel from India without the imposition of duties.
