Anti-dumping

On October 8th, 2009, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate a sunset review of the anti-dumping duty imposed on imports of monobutyl ether of ethylene glycol - EBMEG from the United States of America (Circular Secex No. 51, 08.10.2009).
The product subject to investigation is classified under the following HS code: 2909.4310.
The application for the review was lodged on April 28th, 2009 by Oxiteno Nordeste S/A Indústria e Comércio. The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on October 9th, 2009.
The existing anti-dumping measure remains in force during the review.

On October 5th, 2010, the Brazilian authorities decided upon the continuation of the definitive anti-dumping duty imposed on imports of monobutyl ether of ethylene glycol - EBMEG originating in the United States of America (Resolution Camex No. 73, 05.10.2010). The amount of the duty is USD 670.42 per metric ton, at the exception of the company The Dow Chemical Company whose exports are subject to a duty of USD 377.34 per metric ton. This definitive duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on October 7th, 2010.

The original anti-dumping measure was imposed on October 5th, 2004 by Resolution Camex No. 29 (published in the Federal Official Gazette of Brazil on October 11th, 2004).

On July 3rd, 2014, the Brazilian authorities decided that the preferential duty of USD 377.34 per metric ton granted to The Dow Chemical Company should also be granted to its subsidiary Union Carbide Corporation (Resolution Camex No. 51, 03.07.2014).
This decision follows the application lodged on May 19th, 2014 by The Dow Chemical Company.
This modification entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on July 4th, 2014.

On October 2nd, 2015, the Brazilian authorities decided to initiate a sunset review of the anti-dumping measure imposed by Resolution Camex No. 73 dated October 5th, 2010 on imports of monobutyl ether of ethylene glycol - EBMEG from the United States of America (Circular Secex No. 63, 02.10.2015).
It follows a request lodged on April 30th, 2015 by Oxiteno Nordeste and Oxiteno S.A. Indústria e Comércio.
This sunset review started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on October 5th, 2015. The existing anti-dumping measure remains in force during the review.
 
On 28 September 2016, following the conclusion the above-mentioned sunset review, the Brazilian authorities extended the definitive anti-dumping duty on the above good from the United States (Camex Resolution No. 90). The amount of duty is USD 670.42 per tonne. The duty is in force for a period of five years.
