Complete Title:
Argentina: Definitive anti-dumping duty on imports of polyester textured yarn from China, Chinese Taipei and Indonesia and subsequent expiry for imports from Chinese Taipei and Indonesia; Provisional anti-dumping duty on imports of polyester staple fibres from China and India and subsequent termination of the investigation; Initiation and subsequent termination for imports of polyester staple fibres from Indonesia

On November 12th, 2008, the Argentinian authorities decided to initiate an anti-dumping investigation on imports of polyester staple fibres (not carded, combed or otherwise processed for spinning) from China, India and Indonesia as well as on imports of polyester textured yarn (other than sewing thread), with titration greater than 80 decitex but not exceeding 350 decitex, from China, Chinese Taipei and Indonesia (Resolution 374/2008, 12.11.2008).
The products subject to investigation are classified under the following HS codes: 5402.3300 and 5503.2090.
The complaint was lodged on December 28th, 2007 by Manufactura de Fibras Sintéticas S.A.
The investigation started on the day following the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on November 18th, 2008.

On September 18th, 2009, the Argentinian authorities decided to impose a provisional anti-dumping duty on imports of polyester staple fibres (HS code 5503.2090) from China and India as well as on imports of polyester textured yarn ( HS code 5402.3300) from China and Indonesia (Resolution 394/2009, 18.09.2009).
The duty takes the form of mimimum export prices FOB. The minimum export price for imports of polyester staple fibres originating in China and in India is USD 1.55 per kilogram. The minimum export price for imports of polyester textured yarn originating in China is USD 1.85 per kilogram. The minimum export price for imports of polyester textured yarn originating in Indonesia is USD 2.00 per kilogram.
This provisional anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on September 25th, 2009, and is applicable for a period of four months.
No provisional duty was imposed on imports of polyester textured yarn originating in Chinese Taipei.
Moreover, the investigation was terminated as far as imports of polyester staple fibres originating in Indonesia are concerned.

On May 14th, 2010, the Argentinian authorities decided to impose a definitive anti-dumping duty on imports of polyester textured yarn ( HS code 5402.3300) from China, Chinese Tapei and Indonesia (Resolution 123/2010, 14.05.2010).
The rate of the duty imposed on imports originating in China is 14.20% of the FOB price. The rate of the duty imposed on imports originating in Chinese Taipei is 6.17% of the FOB price. The rate of the duty imposed on imports originating in Indonesia is 7.52% of the FOB price.
This definitive anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on May 19th, 2010, and is applicable for a period of five years.
The investigation was terminated without imposition of a definitive duty as far as imports of polyester staple fibres (HS code 5503.2090) from China and India are concerned.

On May 18th, 2015, the Argentinian authorities decided to initiate a sunset review of the anti-dumping measure imposed on imports of polyester textured yarn (other than sewing thread), with titration greater than 80 decitex but not exceeding 350 decitex, from China (Resolution 370/2015, 18.05.2015).
The products subject to investigation are classified under the following HS code: 5402.3300.
This follows the request lodged by Manufactura de Fibras Sintéticas S.A.
The existing anti-dumping duty imposed Resolution 123/2010 remains in force during the review as far as imports of polyester textured yarn from China are concerned.
The investigation started on the day of the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on May 20th, 2015.

Since no sunset review was initiated, the anti-dumping duty imposed by Resolution 123/2010 expired on May 18th, 2015, as far as imports of polyester textured yarn from Chinese Tapei and Indonesia are concerned.
 
On 17 May 2016, the Argentinian authorities decided to extend the existing definitive anti-dumping duty on imports of polyester textured yarn (other than sewing thread), with titration greater than 80 decitex but not exceeding 350 decitex, from China following the above sunset review (Resolution 194/2016). This definitive anti-dumping duty is extended for a period of five years.
