Anti-dumping

On April 21, 2010, Ministry of Commerce (MOFCOM) of the PRC released the Notice NO.15(2010) announcing to levy AD duty on Polyamide-6 (PA6, listed under 39081019 in the import tariffs of the Chinese Customs) originating from the US, EU, Russia and Chinese Taipei.

In accordance with Chinese Regulations on Anti-dumping, on April 29, 2009, MOFCOM decided to initiate the AD investigation against Polyamide-6 (PA6) originating from the countries (area) listed above. On October 19, 2009, MOFCOM released the preliminary determination, holding that a causal link between the PA 6 dumping and injury against Chinese PA6 industry. Hence, a provisional anti-dumping measure was imposed.

In accordance with Article 25 of Chinese Regulations on Anti-dumping, MOFCOM published the final determination on Polyamide-6 (PA6) originating from the US, EU, Russia and Chinese Taipei. The amount of the duty imposed on imports from the United States is between 29.3% and 96.5% depending on the company. The amount of the duty imposed on imports from the European Union is 8% and 23.9% depending on the company. The amount of the duty imposed on imports from Russia is 23.9% or 5.9% depending on the company. The amount of the duty imposed on imports from Chinese Taipei is 4% and 23.9% depending on the company. The measure enters into force on 22 April 2010 for a period of five years.
 
On April 21st, 2015, the Ministry of Commerce of the People's Republic of China decided to initiate a sunset review of the anti-dumping duty imposed on imports of polyamide-6 from Chinese Taipei, the European Union, Russia and the United States of America (MOFCOM Announcement No. 10 of 2015, 21.04.2015).
The product subject to investigation is classified under the following HS code: 3908.1012.
It follows the application for a review lodged on February 21st, 2015 by several Chinese companies on behalf of the domestic industry.
The investigation started on April 22nd, 2015 and shall end before April 22nd, 2016. The existing anti-dumping duty remains in force during the review.
 
On 22 April 2016, the Ministry of Commerce of the People's Republic of China extended the existing anti-dumping duty imposed on imports of polyamide-6 from the US, EU, Russia and Chinese Taipei following the above sunset review (MOFCOM Announcement No. 4 of 2016). The definitive anti-dumping duty imposed by MOFCOM Announcement No. 15 of 2010 is extended for a period of five years.
