 On 24 May 2016, the European Commission published regulation 2016/791 amending the aid scheme for the supply of fruits, vegetables and milk to schools.
The scheme is aimed at providing schools with healthy products, however the regulation also hints at providing domestic products within the scheme: "efforts should be made to ensure the distribution of local and regional products".
With the new regulation in place, the scheme for fruits & vegetables and the programme for milk were merged into one scheme. Furthermore, the regulations were amended to earmark 10-20% of the budget (250 million EUR per school year) for educational purposes.
Whereas the budget for fruits and vegetables remained the same, the one for milk and milk-related products was increased by 20 million EUR per year. Hence, only milk and milk-related products are listed as affected product lines.
A state measure in the GTA database is assessed solely in terms of the extent to which its implementation affects the extent of discrimination against foreign commercial interests. On this metric, the state aid proposed here is discriminatory.
