Anti-dumping

On July 28, 2008, the Argentinian authorities decided to initiate an anti-dumping investigation on imports of certain types of pumps of cooling liquid or water for engines from China (Resolution 182/2008, 28.07.2008).
The products subject to investigation are classified under the following HS code: 8413.3090.
The complaint was lodged by R.W. Volckmann S.A. and VMG S.A. The investigation started on the day following the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on July 31, 2008.
On April 27, 2009, the Argentinian authorities decided to impose a provisional anti-dumping duty on imports of the above-mentioned products originating in China (Resolution 150/2009, 27.04.2009). The duty takes the form of a minimum FOB export price of USD 26.30 per kilogram. This provisional anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on May 5, 2009, and is applicable for a period of four months.
On January 27, 2010, the Argentinian authorities decided to impose a definitive anti-dumping duty on imports of the above-mentioned products originating in China (Resolution 14/2010, 27.01.2010). The rate of the duty is 287% of the declared FOB price. This definitive anti-dumping duty entered into force on the day of the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on January 29, 2010, and is applicable for a period of five years.
 
On January 28, 2015, the Argentinian authorities decided to initiate a sunset review of the anti-dumping duty imposed on January 27, 2010 by Resolution 14/2010 (Resolution 23/2015, 28.01.2015). This follows the request lodged by VMG S.A. The review started on the day of the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on January 29, 2015. The existing anti-dumping duty remains in force during the review.
 
On September 25th, 2015, the Argentinian authorities decided upon the continuation of the anti-dumping measure imposed on imports of the above-mentioned products originating in China (Resolution 1011/2015, 25.09.2015).
The rate of the duty is 246% of the FOB value. Pumps manufactured by the following companies are not subject to the measure: Kia, Mitsubishi, Caterpillar, Yue Jin, Chrysler, Cummins, Deutz and Suzuki.
This definitive anti-dumping duty entered into force on the day of the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on September 28th, 2015, and is applicable for a period of five years.
