In December 2015, the government of Viet Nam initiated a new safeguard investigation. A provisional duty was imposed in March 2016 and a definitive duty was imposed in August 2016.

Safeguard

On 25 December 2015, the Viet Nam Competition Authority initiated a safeguard investigation on imports of semi-finished and certain finished products of alloy and non-­alloy steel. The products subject to investigation are classified under the following HS code: 7207.11.00, 7207.19.00, 7207.20.29, 7207.20.99, 7224.90.00, 7213.10.00, 7213.91.20, 7214.20.31, 7214.20.41, 7227.90.00, 7228.30.10 and 9811.00.00. This follows the application lodged on 15 December 2015 by 04 companies.

On 22 March 2016, the Vietnamese authorities imposed a provisional safeguard duty on imports of above steel products. The rate of the duty is 23.3% on certain steel billets and 14.2% on certain long steel products. This measure remains in force for a period not exceeding 200 days.

On 2 August 2016, the Vietnamese authorities imposed a definitive safeguard duty on imports of above steel products. The rate of the duty on certain iron or non-alloy products is 23.3% from 22 March 2016 (the above provisional safeguard duty continued as a definitive duty) for one year, 21.3% from 22 March 2017 for one year, 19.3% from 22 March 2018 for one year and 17.3% from 22 March 2019 for one year. The products subject to this duty fall under the following HS codes: 7207.11.00; 7207.19.00; 7207.20.29, 7207.20.99; 7224.90.00.
The rate of the duty on bars and rods of iron or non-alloy is 14.2% from 22 March 2016 to 1 August 2016 (the above provisional safeguard duty), 15.4% from 2 August 2016 to 21 March 2017, 13.9% from 22 March 2018 for one year, 12.4% from 22 from 22 March 2019 for one year and 10.9% from 22 March 2019 for one year. The products subject to this duty fall under the following HS codes: 7213.10.00; 7213.91.20; 7214.20.31; 7214.20.41; 2727.90.00; 7228.30.10; 9811.00.00.
Both safeguard duties expire on 22 March 2020, if not further extended.

Anti-circumvention

On 26 July 2018, the Ministry of Industry and Trade of Vietnam issued Decision 2622/QD-BCT initiating an anti-circumvention investigation on certain steel products. This investigation follows suspicion that the definitive safeguard duty imposed in August 2016 might be circumvented, see related intervention. The products subject to investigation are classified under the following HS code subheadings: 7213.91.90, 7213.99.90, 7217.10.10, 7217.10.29, 7229.90.99, 9839.10.00 and 9839.20.00. Notably, the codes 9839.10.00 and 9839.20.00 are not part of the HS code list. The investigation follows the application lodged by Hoa Phat Hai Duong Steel Joint Stock Company and Thai Nguyen Iron and Steel Joint Stock Company.

On 13 May 2019, the Ministry of Industry and Trade of Vietnam issued Decision No. 1230/QD-BCT extending the definitive safeguard duty imposed on certain semi-finished and certain finished products of alloy and non-­alloy steel to certain steel coil and wire products following the conclusion of an anti-circumvention investigation. The goods subject to definitive safeguard duties are classified under the following HS code subheadings: 7213.91.90, 7217.10.10, 7217.10.29, 7229.90.99 and 9839.10.00. Notably, tariff code 9839,10 is not part of the HS code list. The rate of duty is 10.9%. The duty is in force from 28 May 2019 until 21 March 2020 unless extended, revised or revoked.
