Labour market access

On 7 December 2015 the Russian Government approved Decree No. 1327. It allows regional authorities to introduce a ban on recruitment of foreigners who work on the basis of patents. 
This new rule in practice affects almost all foreign workers because:

  1. they come from visa-free countries (the vast majority of all foreign workers);
  2. foreign workers from visa-free countries are obliged as of 1 January 2015 by Federal Law No. 357-FZ to purchase a patent in order to work.

 
Note: A patent in this case should be understood as a "work permit" and not in its traditional sense related to intellectual property law: 
"a document confirming '...' the right of a foreign citizen who has arrived into the Russian Federation in a manner not requiring a visa '...' to temporary employment on the territory of the Russian Federation" (Federal Law 357-FZ).
