On 20 March 2015, the Indonesian president issued regulation 38/2015 on private-public partnerships in infrastructure public procurement.
The regulation allows foreign entities to participate in private-public partnerships as long as they are classified as an Indonesian limited liability company before they get to be stipulated as a partner in utilizing state-owned property. Nevertheless, this represents a liberalisation for foreign companies in Indonesian public procurements, since previous regulations required the prioritization of domestic service suppliers (cf. Related Measures).
The regulation came into force on the day of its issuance.
The list of affected trading partners is based on Bank of Indonesia's 2014 FDI inflow statistics for the sector "Construction".
