NoResolution 82 that has been adopted by the Brazilian Foreign Trade Council on 25 October 2018, has consolidated the resolutions that constitute the List of Exceptions to the Common External Tariff. As a result, 124 resolutions have been revoked. The list of legislation dates back to resolutions adopted in 2002.
Concerning the GTA-reportable timeframe, one of the main consequences of this modification has been the decrease of the import tariffs of 35 tariffs lines due to the elimination of the tariffs increases that were imposed to them. In this sense, tariffs have decreased from values ranging between 4% and 35% depending on the product to values ranging between 0% and 16% depending on the product.
List of Exceptions to the Common External Tariff
The tariff codes were included in the List of Exceptions to the Common External Tariff (LETEC) of Mercosur. LETEC is a mechanism that allows member states of Mercosur to apply customs duties that are lower or higher than otherwise listed in the Mercosur Common External Tariff schedule. However, the tariffs shall not surpass the ceilings given by the WTO.
Mercosur Decision CMC no. 26/15 gives Brazil the right to maintain a LETEC of 100 codes based on the NCM until 31 December 2021.
